Pending I-131petition for parents with tourist visa

Hello,

 

I am planning to file a petition for both my parents next month, but would like also for them to come visit us this year maybe atleast for 3months. They already have multiple entry tourist visa and have been here in the US 2017 and 2018. Is it possible for them to use the tourist visa after I file for their petition? could someone please advise.

Yes they can continue to use the tourist visa - why not?    BTW you will file I-130 petitions.  And length of stay is determined at the POE.

As long as they have ties back to home they will be fine.

Hello again, is it possible that the immigration will not allow them to enter US because they have a pending petition? Because I need my parents to be here and help me with my kids for me to be able to work and have enough income(already including husband’s income) for the time I have to submit the affidavit of support.

Technically yes.  But as long as they have sufficient ties and plans to return they should be good.

That is illegal work on a visitor visa.  Suggest you have a better plan.

Babysitting is work.  Paid or unpaid.  Babysitting for 4 months is very problematic.

It happens.  Better now than later for them.   Met a nice smart Mexican lady at theimmigrantt legal clinic a few months ago.   She went into her AOS appointment and was asked why she had visited the US so much before doing her K1.   She replied that she has taking care of her sister's kids . . . guess who needs a lawyer?  

 

I know it is in the Filipino culture to help.  My wife and I still support her family.  She is going to go start her nursing program next fall. She is all worried about the money.  So I'm going back to more consulting work.

 

You just have to find something that doesn't hurt your parents and also helps you.

I know! Really appreciate all the advise.. I guess my husbands income and my babysitting job that would have a total of 50k would be enough for my parents affidavit of support. I have 2 babies so a total household of 6 including my parents.

Hi, i have a pending petition that was approved on December 17,2019 and I recently travelled to the US a week ago and I had no problem at the POE. My husband is a LPR and since my petition has been filed in February 2018, I’ve travelled to the USA multiple times. I think it’s important to note that I have a daughter who is a Permanent Resident and she resides with me in our home country so I travel with her often to visit her father (my husband). 
I have always heard that once a petition is filed then it’s harder to travel but so far I haven’t had any problems so maybe your parents won’t.
