We have had some difficulty with the Social Security Office here. We were told that since my minor step-son is here on a K2 visa he cannot receive an SSN. I called USCIS who advised me to apply for a work permit for him to get an SSN. He is eight years old and none of this makes any sense to us. Are there any of you that have experienced this and could advise? Thank you in advance. Ron and Marlou

You should have applied before you got married.

But there is some dispute as to whether you are eigible after you have married.

Otherwise you need an EAD or GC.

You should have applied before you got married.

for K-2, needs EAD or green card. we were told same thing at SSN Office. only K-1 can get SSN before I-94 Expires.

Everything you report here is correct.

My advice is to wait until the child adjusts status to get him a SSN. If his adjustment has not been approved by the time you are ready to file your next tax return then apply for an ITIN for him along with the tax return.

My son is 15 and we had to wait until he got his greencard before we could apply for a SSN for him. They would not let us apply until he had his greencard.
