EB-2 NIW - Job offer required at the time of Consulate Inverview

Hi,

 

my EB-2 NIW petition was approved a few months ago and we went through the NVC process with no issues. We are going for consular processing at a Western European US consulate. Our green card interview at our local consulate is set in a few weeks and while I know that for the petition itself I did not need a job offer, I wonder if I need to present one during the interview at the consulate? Anyone who successfully went through the EB-2 greenb card interview with no job at hand?

To my knowledge, if a National Interest Waiver is approved for an EB2, then you do not require a job offer or labor certification.

I believe you do not need a job offer, but you do need to provide evidence that you are still working on the same field of your I-140 based and that you are not subjected to public charge, which may require to show that you can financially support yourself to be in the USA. That's my understanding of an AOS based on approved I-140 EB2-NIW.

Hi @Nana B , glad to hear about your interview. Would you mind sharing how was your experience at the consulate? I mean, ehat is the whole procedure is like, what type of questions were asked, and how long was the interview. It would be much appreciapprecia'm in the same path and looking to familiarize myself. Thanks a lot.

Hello the interview was great. The consular told is our case is the first EB2 NIW case she will be doing. We took the oath, asked about profession and asked the day I left the US. Our case is still under AP waiting. 🤞🏽🤞🏽🤞🏽
