I am a k1 visa applicant and after my interview on July, the consular officer found our relationship to be bonafide and asked for tax returns which I presented but later requested 2018 tax transcript.we couldn't immediately get d transcript so I submitted the IRS signed copy  TAX RETURN WIT MY fiance sending a mail saying once the transcript is ready,it will be sent. Exactly 2 weeks after interview, it was at the drop office say 9 am but by 1 we received a mail saying our Petition would be sent back due to incomplete documents and recommended for revocation. We immediately sent a message saying all the documents were already in their drop office and  they should please review what has been sent but we received no response. When the Congress got in touch, they informed us it was in USCIS already despite their repeated attempts to ensure it wasn't returned. USCIS sent a message that they will review and get back. Our case is still under adminstrative processing and at the time of my interview, it already expired but consular officer extended due to it not being our fault. I am confused, do we still wait as we have technically not been denied or should we just get married and apply for a spousal?

Since you went to all this trouble in contacting your congress representative and that USCIS is reviewing your case I'd say it would be a little early for you to "throw in the towel" and go the CR-1 route. I'd say another 60 days you may have an answer at which time you can make those decisions. Be patient.

Yeah thanks but everyone says once k1 visa is returned back to USCIS, they just ignore it and Don't usually respond back cos it's not prioritized. That's my confusion. We started this process August 2018 and my interview was July 2019, so sometimes I think if we will eventually get a response from USCIS or if we just waiting in vain...do USCIS usually respond to k1 visa?

You said that USCIS is reviewing your case, that's not something that I opined. Based on what you said, I recommend that you wait. You are still free to do what you think is best for your case. Good luck.
