My aunt talked to one of the immigration agency that helps with the paperwork and the lady told her that there is a 6 month limit once you get your Aff. of Single Status. Is that true? I got mine around august (3 months ago) and my fiance didn't get hers but they gave her a divorced paper (6 months ago) in place of it and said it should be sufficient. They also said that getting the Spousal Visa is easier than getting the Fiance Visa. Anyone have any experience with this? She's from VN and I'm from America. I got my naturalization certificate through my father and am now a US citizen. We met 2 years ago and I have been going back the past 2 years to visit her so now I'm not sure which route would be best for me.

K-1, I-129F does not require an affidavit of singleness.  The requirement is both free to marry, if married previously copies of divorce decrees, death certificate or annulment  .. there is no requirement for an affidavit.  2nd requirement is having met within 2 years of filing the I-129F.    https://www.uscis.gov/i-129f

 

This could be an embassy requirement but is not a USCIS requirement, embassy requirements vary from country to country.

 

As for completing K-1 or IR/CR-1, aside from the IR/CR-1 visa taking a few months longer it has many benefits over the K-1; cost less, spouse has LPR status once clearing POE so can work or travel outside the country almost immediately (need SSN to work).

"Affidavit of Single Status" isn't a thing, at least not in the US.

Did not know that. I suppose this is only required in VN because when she asked for her papers so she can get married, they asked my proof of single status paper if I remember correctly. But if I intend to bring her to the US through K-1 fiance visa so i can marry her here, then I would just need her divorced papers? How would I bring her here through the spousal visa? Would I have to go to VN and get married there ? But then that would require the SS affidavit from me correct since it may vary in VN.

 

I also heard that they will interview her at the embassy when applying for the K1 Visa, and then interview her a 2nd time once she comes over. Is that true? Thanks.
