RFE for our CRBA application. Please help

Timeline

I am a K1 visa HOLDER, my fiance applied for CRBA for our 6 year old daughter. During interview we were advised that my fiance needs to submit further evidence to prove his 5 year physical presence in the US.prior to the interview we had submitted the following documents for the embassy: 

. Title deed for the house owned in US

. Employment letter

. Old British passport.

 

We were advised that the above evidence isnt sufficient to prove physical presence. We were told that fiance cannot submit sss and W2 as he can file for those while outside USA. Is there any other evidence that other people submitted to meet this requirement? Can we be denied if we do not meet this criteria? Do we need wait 90 days before they can make a denial decision. We were hoping that if we receive denial letter, than we can proceed to  add our daughter as a K2. Any guidance and assistance in this matter will be highly appreciated.

Timeline

If you don't have anything like school, mecdical, or employment records, your chances of being approved are slim. Ask them to base the decision on the evidence provided. You will then be denied and will be able to go forward with a K2.

It's amazing how many questions can be resolved with a 2 minute Google search...

Thank you for responding. So, we don't have to wait for 90 days stipulated in the letter before we can respond and request for decision based on current evidence presented?

Timeline

If you read correctly, it says "within" not "after". The only thing that will happen "after" 90 days, if you DON'T respond, is that the case will be closed. 

It's amazing how many questions can be resolved with a 2 minute Google search...

When my fiancée and I did our CRBA back in September 2019, I presented W2s, stamped out passport, and most importantly, MY SOCIAL SECURITY STATEMENT, which showed a history of payments to US government since age 18. Usually, that should be enough to push you over the edge and get approved. Otherwise, you will have to decipher your old passports and prove that you've spent 365 days * 5 years = 1825 days inside the USA.

Thank you for your response. They eventually accepted my fiances documents....and we did DNA. We finalized process in February  and are now in USA
