I have been reading hours upon hours of threads and other internet articles about PArt 6. 24.a,b,c (income tax info for last 3 years). I have read lots of conflicting information.

 

My Wife is the USC and we got a joint sponsor for the i864 requirements.

 

Joint sponsor is self employed. He filed taxes as married filing jointly. He makes 70k per year as self employed.

 

what numbers should he be filling out in these 3 boxes? IS it line 22 of the tax forms For the income for the past three Years? (As some posts on VJ indicate)

 

Or

 

does he need to put $66000, as per this article? (https://www.irs.gov/e-file-providers/definition-of-adjusted-gross-income)

 

I am so confused, and have spent numerous hours trying to get the paperwork done correctly. I do not want NVC to send things back to me.

A self employed person's current income AND what they would put in the prior tax year's boxes comes from line 6 for the 2018 tax return (That is also the current income number.) and line 22 from the other two prior years boxes.

 

You say he makes 70k per year.  Is that coming from line 6 of the 2018 tax return?

 

Note that business revenue and business income are not the same thing.  "Income" in this context is what appears on line 6 AFTER taking allowed expense deductions.

Thank you very much. :) .... yes, 2018 income is from line 6 of 2018 Tax Return. (okay, I will put that in box for most recent tax AND in the current income)

 

My friend files his taxes jointly with his wife.

 

From the instructions: am I reading this correctly:

 

if he provides IRS TRANSCRIPTS, and has filed jointly with his spouse, and wants to use ONLY HIS income (He makes well over the poverty levels based on form i864P) for joint sponsor qualification; he must then add his w2's.

 

ALSO

 

since he is self employed, he must also provide all of his 1040 schedules ( c, d, e, f)

 

This is my understanding from reading the instructions.

 

LASTLY:

 

Am I correct then to establish, that his wife DOES NOT have to provide a i864a, if the aforementioned is provided?

 

(or, should she fill one out, just in case? ------ she has not worked since mid 2018)

Can't go wrong with your plan, plus an I-864a from the joint filing spouse.

So, I should get an i864A from his wife, albeit, he earns well over the required amount? (he was wishing that it was not necassary to add her, but will if we need to).

 

If, we have to add her, as i864A, she too was self-employed, but had NO W2's. (this may cause RFE?)

Consular Officers and NVC staff know the self employed don't get W2 forms.  No worries.

As a result, do you think I would need to upload the same IRS transcripts, for his wife, as I would do for him? (seems redundant, but will do if necessary).

 

since they file jointly; where would I look for her income? Line 6 / line 22 as well (or are those lines the total income for both of them?)

Totals for the couple are on 6 and 22.  Only one set of supporting financial documents.  Be sure to submit evidence of Green Card or Citizenship status for the joint sponsor and his wife.
