My husband was denied because He had a control substance in 2000 and was fined for smoking weed. He payed his fine and never went to jail. The lady at the embassy looked it up and gave us a 221g form to show court documents of the case. We got the paperwork and sent in oct 16th. Weeks later we got an email for him to pick his passport up and gave him a letter. They kept his police record and medical records. The letter was for denial of passport and misinterpreted of fraud as if he lied and he didn’t. So now I have to do the i601 waiver

If he completed his DS-260 and never mentioned the arrest and drug charges, then he has a misrep.  Google Lizz Cannon - atty.  She specializes in JA nationals with drug charges like this.  Good Luck
