Not sure what to do. I submitted the I-130, I-765, and the I-485 together. Once I sent the documents off I realized that I did not separate the fees correctly and knew it would be rejected. I got a rejection notice for my I-765 because the fees were not correct and I did not include all the pages. Before I got the rejection notice I went ahead and resubmitted without waiting for the rejection notice because I thought it was just going to get rejected because of the fee amount. Not realizing it was going to be rejected because of the fees and the pages. For example, the application has 20 pages, I only include the pages 1-18 because the remainder did not apply. Not sure what to do in this situation..I have resubmitted again without the all the pages but with the correct fees thinking it was going to be the only reason it was going to be rejected. I should have waited on the rejection notices and then resubmit. So now I have another set of application already sent with out knowing why they would have been rejected. Should I wait for everything to come back, or just wait for the complete first set to come back and submit the correct way?

Wait.   First there shouldn't be a fee for the I-765 if filed together with the I-485.  Make sure the I-485 was accepted and the submit the I-765 along with an I-131 with a copy of NOA-1 from the I-485.   There will be no charge.

 

You seemed to be in a rush.  Did you also include the I-130A with the I-130 filing?   Did you also include the I-864?

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

**Moved Topic to Adjustment of status. This is not about Tourist Visa**

 

Okay this is what you need to review and make sure. Always wait for the letter. Slow down.
You really have to slow down. Please list every single application you sent in. I assume you are adjusting from a visitor visa or other kind besides a K1 that's why the I-130.

 

You should have submitted.

 

1. I-130 and I-130a - $535

2. I-485 - $1225

3. I-1765 - Fee waived

4. I-131 - Fee waived

5. I-1693 - No fee

6. I-1864 - No fee

 

Every page no matter what must be sent in along with all your evidence, pictures and whatever else you plan to submit

Thanks for replying to my response I am feeling a lot better. I was in panic mode all weekend. After talking to a few people that has been through the process, I understand it more.

 

Okay taking a step back. My husband has a visitor visa. I think I was rushing to get some type of status or something pending because he is coming up on his 6 month since he has been here and I did not want him viewed an overstay. When I called USCIS, they told me to wait until I get all the paperwork back and resubmit, but if I wanted to submit without waiting for the second packet I can. I need to make all the necessary corrections and resubmit the original packet. I sent everything off on Monday once I received all the rejection notices. As for my second case I should get that back in a week or so, I will just keep that packet and wait for a status update on the original packet. I submitted the I-130, I-130A, I-865, I-485, and the I-765.
