Our case is sent back to NVC already. What should i do next? I contact Marc Ellis, but he is very busy. Please give me some advise, do i need to appeal with this case or apply a new K1? Is K1 or K3 better? Do i need to wait for this K1 expired first?

Can i apply K3 at the USA consulate in Ho Chi Minh? :crying:

Aug-14-2006: Cali service center received

Aug-15-2006: NOA1 (14 days)

Oct-23-2006: touched the 1st time.

Oct-24-2006: touched

Oct-25-2006: touched

Oct-31-2006: Email notification of RFE

Nov-17-2006: IMBRA sent to CSC

Nov-21-2006: touched ------- CSC received IMBRA

Apr-19-2007: Our case is sent back to NVC

Jun-29-2007: received email from CSC saying that our case is requested for review. (334 days)

You need to get the advice of a good immigration/family-based attorney to review everything in your case (and his previous case) before decided to start another process. From reading your previous posts, you've got some road blocks that will need the experience of a professional to navigate.

I'm sorry to hear your bad news but your questions indicate to me either an extreme lack of understanding of the process or a lack of willingness to deal with and/or provide the details necessary for success or to get help.

K3 visas are for married people, so no, at this point you can't apply for a K3 visa. First you would have to marry, file an I-130 petition and an I-129F petition for a wife, get the I-129F approved, clear name checks and NVC and then, after the case is transferred to Viet Nam, your "wife" would apply for a K3 visa. It sounds like you need to sit down with a competent immigration attorney.

Before doing any of that, you need to examine and clear up any issues that caused your K1 denial.
