Hi All,

 

I am hoping that you could help me with my query.

 

I received my green card last September (CR1) I haven't completely moved to the US yet because of my work commitments in Dubai. My contract will finish next year June as well as my studies. I have decided to move to the US in June 2020. Till then i will visit my family with my wife  to the US every 5 months for a few weeks. I have done that twice already. This time when I go i wil open a bank account and start transferring my savings.

 

I hope there wont be an issue since I'm travelling to US with 180 days. Can anyone please put some insight

The only insight is that depending on which immigration officer you meet at the airport, you might either enter smoothly or get pulled into secondary and scrutinized as to whether you’re meeting the conditions of permanent residency.

 

As repeated over and over, spending a few weeks a year in the USA is not proof you haven’t abandoned permanent residency.

So you have been or will be in the US for 4 months of a 2 year period?

If you are spending more than 180 days of a 365 day period during, times two, you are not maintaining residency in the US.   Even if you don't have an issue at CBP, you are going to have an issue at ROC.   Setting up a bank account in the US does not in and of itself establish domicile.

 

Further if you intended to become a USC that clock hasn't even started.

 

You should have waited to file the I-130 to when it better fit your obligations.

July 14, 2020 Removal of Conditions submitted by mail  July 12, 2021 Biometrics Completed

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well
