required civil documents, marriage certificate, proof of US citizenship for petitioner, passport photos, payment of fee, everything stated on I-130 instructions, plus I-130A application

 

All of the above well-organized on plain paper, binder clips, with a cover letter/table of contents listing everything by page number, all pages clearly numbered for easy reference for the officers.

 

We uploaded more evidence at NVC stage of 3 additional visits since filing the petition.  We're now two weeks from his interview, and I will go with him and take evidence of our 11 day trip to Paris and London last month.

Thanks for the reply! I'll be sure to include as much stuff as I can that's relevant to what you included. Just curious, did your husband travel to the US at all after you filed your petition?

"Sign" the cover letter, check and I-130.  No other signatures at this time.

We got an rfe for not including passport photos for my husband (beneficiary) with our I-130 even though my husband lives abroad. My lawyer said when they say jump we say how high and please and thank you. Basically, just give them whatever they ask for even if it's not supposed to be necessary.

Yes, USCIS makes mistakes, particularly with new policies.  Not sending beneficiary passport photos is a fairly new policy.  When they ask, you respond.  It never hurts to send beneficiary photos if you have them, but they are NOT required with the petition if the beneficiary is NOT in the USA at the time of filing.

Facts are cheap...knowing how to use them is precious...

I just included both. Copy of every page in my PP and a copy of my birth cert. Figured I have it so why not. 

I was going to include photos of her but decided not to once I saw it was not needed. But I did make a note on the cover letter they were not included at this time and why. 

 

I copy/pasted the correct address format in Japanese and Chinese in the Additional Information section.  She's Chinese but a perm resident of Japan but was on assignment in china when we applied for the I-130. 

 

Since we've applied I've added her to my insurance and put on as an authorized user for my CCs. On her next trip here we will file for a ITIN.  

 

As far as some of the other things that were probably not needed but:

  • I included cards we had sent to each other..... OK cards I had saved the cards I sent her (for over 10 years)
  • Some old emails 
  • Somehow I still had copies of airline tickets from a trip we took together 10 years ago
  • Copies of her I-94 showing prior visits to US
  • Photos - Printed 4 on page using a color laser printer. Some of the wedding, some of prior trips, etc. I think 20ish total
  • Copies of our joint bank account

Response 2: Feb. 18, 2020 - Tokyo Embassy - Requested transfer fm China - Case moved to Administrative Processing 

A Short Time Later after talking with Rep. Case's office, they contacted the embassies again. 

Response 3: Feb. 21, 2020 - Transfer complete; New interview scheduled.

 

Interview Date: Mar. 2, 2020 - Tokyo Embassy 

Interview Result: Approved

Visa Issued: Mar. 4, 2020

Visa in hand: Mar. 6, 2020

 

Time: ~359 Days from start to finish 

POE:  Stupid COVID-19 delaying travel to the US....

POE: Aug. 13, 2020 - San Francisco 

 

SSN: Oct. 23, 2020

GC: Aug 5, 2021 (51 weeks from entry)

NOA1 - May 20, 2022 CA Service Center

NOA2 - July 20, 2022 Case Transfered to NBC

NOA3 - Mar 6, 2023 48 month GC extension letter

NOA4 - Sep 1, 2023 Biometrics Appointment 

Update - Oct 6, 2023 Case status update to show fingerprints taken
