Afidavit of Support for spouse?

I am petitioning for my husband. My case is at NVC and I have "ceac.state.gov" case and invoice number to log into the website. I became disabled a couple years ago and do not work, so my brother will be a sponsor. My question is do I need to file an i-864? If I do, what do I put for "1e" on i-864? Am I the first/second joint sponsor or am I not a sponsor at all? ceac.state.gov is asking for my i864 and tax return. Also, last time I filed a tax return was in 2017, the year I became disabled. Should I submit that or not submit one at all and explain why I did not submit?

Yes. As the petitioner, you must submit an I-864 even if you can't sponsor on your own.

You check box 1.a. since you are the petitioner.

Your brother would check 1.d. as the joint sponsor on his I-864.

I'm assuming you weren't required to file 2018 taxes as you didn't have reportable income. If you did have reportable income for 2018 above the minimum threehold to file, then you must file before you are eligible to provide an I-864.

 

Otherwise...

For question  #24, you will need to provide the income information from your taxes for 2016 & 2017. For 2018 you can enter $0.

 

For #23.a. you would check "No" since you didn't file for all 3 years. You would also check box #25 since you weren't required to file for 2018 due your income being below the threshold required to file. No tax return copy is needed since none is available. I think you can mark the tax return as either Unavailable or Not Applicable on the website, but I will defer to others here for specifics.
