Hello family. I have a worry and decided to bring it here. Some one with similar situation can help. A friend of mine ask me what to do if the sponsor which is a u.s citezen petitioner(spouse) did not make any money in 2016 so did not file for the tax year . But did filed for 2017 and 2018. The big point is when filling up the the form 1864 what should be filled in 2016 which is the 1st year within the most recent 3 years? When going for the interview.. what document should the beneficiary take to justify why the sponsor did not file in 2016?  What can he do in this situation? Please anyine with idear on this? His interrview is very close

What most people do in a situation where they didn't make enough money to need to file is write a simple and signed letter stating that for the 2016 tax year his or her income was below the minimum requirements to file for that year.  You may put down the reason, if there is any, such as medical leave or unemployment.  You can also provide proof of income if you have any, but it isn't required.  Most importantly just be truthful about why in 2016 you did not file.
