Hello ,

I am an US green card holder going to apply for my wife under F2A category , the confusion is that my Nikkah ( Wedlock) was done over the phone in july 2017 (i did not go to pakistan because of my  classes )but i went to Pakistan for 3 months in August  2018 and did the rukhsati and we spend 2 and half months together ,  i've not filled visa petition for her till now , so based on my situation can i file a petition worry free or is there any thing to worry about .

A proxy marriage can be recognized so long as it is consummated afterwards. For USCIS purposes, this just means meeting in person afterwards. Be sure to provide evidence of your in-person meeting with the petition.

The specifics for what counts as a legal marriage in Pakistan is beyond my knowledge so I can't comment on that subject.

 

Pakistan is a very difficult embassy to go through, so make sure you have and send plenty of bona fide marriage evidence.

Thank You Geowrian , v have photos together ,one domestic air ticket and my wife is pregnant too so by the time of her interview v will have a baby too .  do u think those r enough proofs that the marriage is legal .

I'd not be too confident with just that amount of evidence of a bona fide (not just legal) marriage. They typically want more time in person, evidence of regular communication (call records, chats, etc.), any form of financial commingling you can do (even if it''s just listing each other on life insurance or retirement policies, healthcare directives, etc.).

I hope others that have personally dealt with Islamabad will chime in with their experiences. In the meantime, here's the Pakistan portal with threads you can read through.

Congrats on the upcoming child!

That said, the child likely would not be considered evidence of a bona fide marriage.

If you are the petitioner, as a green card holder expect about 2.5 years or so from filing to interview.

This is not a processing issue but a limitation on the number of visas available in the F2A category (which includes the spouse of a green card holder). This part of the wait for a visa number to become available (currently ~2 years) is mandated by the INA, and cannot be expedited.
