RFIE asking for proof of lawful employment in the US (F1 AOS)

So I received the RFIE in the mailbox today asking me to prove I am legally employed in the US since I use my income with my wife for my AOS package.

I've been employed by my school since Mar 2015.  Except for 3 months of summer of 2016 I interned at a company under CPT, the rest of my income solely came from the school.

In the letter, they gave me 3 options:

 

1. Showing the I94 with visa category that allows me to work legally. It listed out almost all the visa but not F1. Weird because F1 is allowed to work part-time during school being in session and full-time during breaks. Wonder why it was conveniently left out in the list.

2. Unexpired EAD which I don't have.

3. Showing the I94 with "authorized for employment" on it, I don't have this either.

 

Is there anyone experiencing this before? What did you submit?

Are you on OPT or just a "normal" student on F-1? Generally, they will not accept income earned on F-1 (but may do so if it is OPT).

10/24/18: Green card produced notice, 10/25/18: Formal approval, 10/31/18: Green card received

I'm not on OPT yet. What's weird is they do list J1. 😕

Yup. I'm not saying I agree with it or not, but that's what I've seen others go through.

It seems this guys was in the same situation as mine and he did it successfully. Should have researched before posting, stupid me.

If you're referring to the second poster, that sounds like an OPT case off-hand.

The OP did not state if they were ever successful with the RFIE response (Edit: Sounds like it was eventually accepted based on latter posts on other threads).

Yeah I am reading his posts and it seemed he got his GC in October.
