Hello,

My I-130 was approved in April 2018. USCIS claim that the files were sent to NVC on April 25th 2018. In June, I emailed nvcresearch to try and locate my files. In September, they told me that they finished their research and my files could not be found. They claim that they have reached out to USCIS to have the files recreated and resent. It has been 6 months since my I-130 was approved. USCIS does not answer any questions. So I dont know how long this recreation and retransfer will take. Anyone familiar with this process? It is now more than 6 month since my I-130 was approved and NVC has nothing.

Hi Nabil, sorry for the awful experience. I also start to worry about my case. My petition was approved in August but haven't been received by NVC yet. After 6 weeks of waiting, I sent an inquiry email to nvcresearch but haven't heard anything yet. How long had you waited before you got response from nvcresearch?

NVCresearch never responded to me directly. I know that the call center will tell you to rescan and resend the email. I did 3 times, never got a resolution except the first email stating that they are working on your case. I am getting my information from my congressman's office. They were the ones that talked to NVC and NVC told them that they couldnt find the files and requested a new copy.  Here are my dates:

I130 approved: 4/19/2018

Initial NVC email: 6/24/2018

Congressman's office got engaged on 8/6/2018

Congressman told me that NVC will ask USCIS to recreate the files 10/08/2018

If your situation is similar to mine, It is a black hole, filled with a bunch of incompetent people whose only goal is to get rid of you as opposed to helping you.

Hi Nabil,

 

Thanks for sharing the info. I completely understand the frustration you may have experienced during the whole process. Too much waiting, uncertainty, and helplessness. Sometimes I wish these people could understand our feeling just a little bit and be more responsible when handling our cases. 

My I-130 petition was approved on 8/28. USCIS told me that they sent my petition to NVC on 9/4. However, NVC always told me there was no info of my case in their systems. I may also contact my congressman's office soon. Let's keep each other posted.

I suggest you contact your congressman soon. NVCResearch is a waste of time. Your congressman's office will ask you to sign some release form so they can talk to NVC. They deal with the office of congressional liaison not NVCResearch. Here is what they told my congressman's office: 

"We, in the Congressional Unit, usually receive responses at a faster rate due to the nature of the inquiry. " So your congressman's office will get info faster. I wish you luck. Hopefully your case is not lost like mine, but rather just a regular delay.

Hi Nabil, I would like to give you an update on my case. Before I was about to contact my congressman, I decided to give a call to USCIS to confirm whether they had sent my petition to NVC. Luckily, a nice lady answered my call and escalated my inquiry to a tier-2 office. The tier-2 officer found my case was still sitting at USCIS 2 months post approval. She said it was strange but she would take a look. Today I called NVC and was told that my case just arrived at NVC today!

The lesson I learned is that some officers at USCIS made up things sometimes. One officer told me earlier that my case was sent to NVC on 9/6. That's why I had kept calling NVC to check if they had received my case. 

You might also want to call USCIS and request to speak with a tier-2 officer. Tier-1 officers may not have access to our cases. Good luck!

Thanks for the update. I am happy for you. Unfortunately, that is not the case for me. I spoke to USCIS tier-2 many times and requested 2 inquiries so far. They all claim that my case was sent to NVC. NVC sent me the following:
"NVC submitted a request to USCIS' Potomac Service Center (YSC) to consider a reconstruction of the petition. A reconstructed petition is one created and approved using copies of the initial paperwork submitted. Typically, no new fee is required if the reconstruction of the petition is required as a result of U.S. government error. Acceptance of a reconstructed petition and waiver of a new fee is at the discretion of USCIS. You will be contacted once NVC is provided this reconstructed case. You may contact NVC at 603-334-0700 if you have any additional questions about the petition."

You see how they are using words like "consider". This is a nightmare for me and my family, but neither NVC nor USCIS care, so they are taking their time with it.

Just in case someone is in this situation. I received a update from USCIS stating that my case was approved on Nov 15. So out of nowhere, they just sent me this update. When calling USCIS previously, they said that they did not know anything about my files missing or a request from NVC for reconstruction of files. 

so to recap, my case was approved in April 2018. NVC never received my files, so I sent an email to nvcresearch in June. I haven't heard anything until September when NVC said that they finished the research and could not locate my files. NVC also said that they will request a file reconstruction from USCIS. USCIS kept saying that there is no request and that there is nothing they could do. Apparently, the call center do not see this kind of things in their system. Two months later, and out of nowhere, USICS sent me a notice that my case was approved AGAIN and that my files were sent to NVC. So I am waiting for NVC to get them again. Hopefully, they wont be lost this time.

This is a rare situation, so I wanted to post as much info as I can just in case people have the same issue.
