Hello, we have filed K-3,and will take that visa as quickly as we can ! I have also filed the I-824 so we can get the CR-1 ! We want to return to China anyways, so this makes sense to us. We possibly can avoid the upcoming Fee increases also ! My question is, Are there others who are doing this, (I-824)? I don't see any of the old threads, and I know that the time until CR-1 is much longer now, but I don't see any historical information, (timelines, etc.). I would like to have an estimate or recent approval time for the I-824, for I-130. Any other thoughts would be well appreciated! Thank you, Mike & Zhen

Also, is it possible to have 2 timelines, K-3 & CR-1 ?

married in Nanning 10/28/06 I-130 mailed 11/24/06 I-129F mailed 12/8/06

I-130 & I-129F both approved 3/1/07

I-824 sent 3/9/07 K-3 sent to GUZ 3/15/07

K-3 P-3 sent 5/30/07 P-3 ret'd 5/31/07 (P-3 rec'd by mail 6/7/07)

Interview 8/8/07 "PINK" entered US 8/27/07

Rec'd approved I-824 & re-approved I-130 10/11/07

after 12.5 mo. DHS Ombudsman sends I-130 to NVC 10/30/08, and asks for case to be expedited

NVC rec'd 12/26/08, NVC to GUZ 1/5/09,

NVC sends email to GUZ requesting Expedite 1/9 or 1/14? DOS says "waiting for interview date" 2/9

Yes USCIS will hold the approved I-130 (CR-1) when they see K-3 being filed for, no sense in running the 2 cases through NVC and all the extra processing that goes with the CR-1 only to have it abandoned when the K-3 is issued and the couple then adjust status in the USA.

USCIS and DOS both were seeing that the vast majority of filers that did K-3 were adjusting status in the USA.

You need to file I-824 to keep the CR-1 moving after it is approved.

Hello Dan, I am at CFL, but I am the only one with the I-824 waiting for approval! Zhen and I were planning to return to China anyways, so we figured that we can beat the Fee increases of the fall, and pay for part of the trip. I am looking for some historical info so I can guesstimate my timeline for CR-01. thanks, Mike & Zhen

I've seen only two reports of I-130's moving after I-824 filing. As I recall, one took three months and the other four, or was it six. I don't see a point in trying it unless you don't care about the extra time. I don't see your CR1 catching your K3 before the interview. If you file the I-824 today and it takes only sixty days to get the CR1 case shipped to NVC, you still have at least two more months using all the shortcuts to the best possible advantage. That puts your CR1 a bare minimum of 4 months behind your K3.

Oops, you already did it. With a K3 NVC out in early March, I would be looking at July interview at the latest. You'll be lucky to pry your I-130 out of NVC before then, much less get it open in GUZ by then.
