What is the correct procedure for withdrawing a petition?

I have looked all over the websites, here and the London Consulate and the visa websites and the FAQ's and somehow I am missing the information on how exactly to withdraw a petition that has made it to the Consular level. I was told I need to write a letter and have it notarized and send it to the London Consulate. I tried to call them but I was lost in a sea of press this, press that. I wrote to the email on file here at VJ and I got a message saying they don't accept emails that are unsolicited to that address.

Do I need to send a letter to the USCIS or anywhere else? Is there someone I should call initially to notify them? I can't seem to actually get in touch with a live human.

Thank you.

If the case is still at USCIS you send a letter requesting the case to be withdrawn note case number in the letter, if it is at the embassy or consulate then call DOS and request it withdrawn.

DOS number 202.663.1225 Then press 1, then press 5, then press 0.

20.4 Petition Withdrawal.

A petitioner or applicant may withdraw a petition or application prior to adjudication. Withdrawal is a voluntary action. It should not be coerced, although it may be suggested as an alternative to a formal denial. Whenever a withdrawal is received, it should be acknowledged, in writing, for the record. Although a withdrawal by a petitioner is not necessarily an indication of fraud, the facts surrounding any prior withdrawal should be considered in the event a subsequent petition is filed by the same petitioner.

You are done with the USCIS so it does no good to send a withdrawal letter to them. I think if you include in the subject line your LON number it would not be considered unsolicited. Other than that a call to the consulate or NVC would be the only other ting I can think of.

YMMV

Most consulates don't accept phone calls, you cal Department of State, "DOS" at 202.663.1225 Then press 1, then press 5, then press 0 and talk to an operator.

Oh!! Thank you so much, I will call the DOS tomorrow morning. I don't think I have the case number -- I was only given the NOA 1 and 2. Would the ex fiance have the case number or can I use the number on the NOA's? I hate to have to talk to the ex again but I will ask if I must.

It's at Consulate -- the visa was actually refused but the ex has info that he can use to overcome that and I just want to make sure he does not since there's a grace period for him to supply it, as I understand. He knows I don't want to marry him, I just want to make it official with the governments involved. I don't feel good just letting it be open ended as it is now.

First call NVC for case number, don't use the automated system it wont have it, just get an operator on the phone.

NVC: 603 334-0700 if the petition is still at NVC then they can cancel it for you.

After I got the automated email saying my email was deleted without being read, I received this reply:

Thank you for the information furnished. The Immigrant Visa Unit

requires you to submit a sworn statement of your wish to withdraw the

petition filed on (the beneficiary's) behalf. Please send this to:

shorter time. No record is being made of this correspondence. If you

need to e-mail us again, please return this e-mail.

I called the NVC and they put me on hold then the auto guy came back on and told me since all the operators were busy, he was sending me back to the automated system. I was on hold again, then got sent back to Mr. Automation who basically told me goodbye and hung up on me. GREAT.

I called the DOS and was told their office is currently closed, open from 8:30 am to 5:00pm on M-F except federal holidays. It's 10:38am central -- is today a federal holiday or is this place located in Hawaii or something?? Huh apparently not since I just called my bank and it's open. What are they telling me they're closed for at the DOS? grrr these automated systems.

I'm heading over to the bank to get my letter notarized and sent to London. I am just wondering if that's all I need to do. I don't even have the case number because Mr. Wonderful never gave it to me (despite my asking a few times.)

The email from London does not say anything about using your case number, just use your ex's complete name & address when you send the letter to them. Use registered post as well.

PS: I've always like your name cuz my folks called me that whan I was little.

DOh. In my haste I only gave his full name and his beneficiary number that was on the NOA2 and the receipt number. I have another letter as I made a copy so i can always add it and do it again.

Will I get some kind of confirmation letter from the consulate?

these people are so hard to get in touch with!!

Is his name common or not? If not, I wouldn't worry about it.

Doubt you'll get a confimation but you never know. Keep a copy of how it was sent as well. You could always try a follow-up email in a few weeks to check on it.

Also, be sure to include your address in there so they can send any correspondence to you.
