Hello,

I have a question;

When I filled a for a K1 Visa for my fiance' back in Febuary I did not enclose all documents needed;

I have recieved conformation they recieved the items I sent in, but they have not started to process my case yet. According to the California Service Center status page; they are processing applications from October 14.

My question is; now that I have better overview of the items needed to successfully file for K1 visa, could I send those items in and have them attached to the information I sent in?

Will this cause a major hickup in processing times? I was hoping I could go to the send the forms in before they start processing my petition, and it would go over smoothly?

Thank you for all your help, and I wish I knew of this site before I started fumbling in the dark trying to put a K1 visa together myself.

Wait until they send you a Request for Evidence (RFE). Otherwise if you sent it now it's very unlikely it will every meet up with your file.

BTW, dates on the CSC processing site are not accurate - they simply reflect the oldest petition they have not yet adjudicated and it's meant to cover their azz. To get a more accurate idea of timing (without RFEs), check the CSC timelines here on VJ.

There's no way to know if you had send all of the required documents if you would still get an RFE. Sometimes they misplace things and sometimes they ask for more information.

If you send it now, even if the case number, it's still unlikely it will ever meet your file. -- they get thousands and thousands of petitions and evidence. It just makes more sense to keep all of the documents together, wait for the RFE, and then Fed Ex everything with a notation on the address line that it is an RFE response. Then they will have everything they need and continue processing and you will not have lost much time.

One last question.. How long does this entire process take from start to finish? I looked at the stats and it suggests 190 days. Does this sound pretty accurate?

190 days sounds pretty long for petition processing. CSC petition processing takes around 3 months - sometimes more, sometimes less. You may have been looking at information from last year when there was a huge delay to the enactment of the IMBRA law.

Overall, for entire process from beginning to end, timing depends largely on your consulate. Once the approved petition has passed through the National Visa Center and to your consulate (that can add a month give or take), it depends on how long it takes them to get an interview date scheduled, send you additional paperwork, how long it takes you to send back any required forms and have the medical exam done.

Wow, I must have done something completely wrong. I sent this off in the beginning of this year, and they recieved it on Febuary 2nd. I have not recieved any more information other then that one document stating the recieved it's still pending.

I will provide you with the documents I sent in.

- Payment in the amount of $170

- I-129F

- G-325A (Petitioner) w/o photo

- G-325A (Beneficiary) w/o photo

I did not include the following documents:

- Birth certificate/US Passport (Petitioner)

- Letter certifying intent to marry (Petitioner and Beneficiary)

- Proof of having met in person in the past two years

- Proof of ongoing relationship [if including]

What would you suggest for my next move? It appears I have done something completely wrong. I was under the impression in the beginning that it would take 3 - 6 months total time. She has been here twice since I filed for this visa.

I wouldn't worry or suspect anything is wrong based solely on the timing -- you're just over three months and that's quite normal. But knowing that you left out required documents, you should expect an RFE sometime in the near future. The fact that it hasn't been sent to you yet doesn't really mean anything more than they are processing a little more slowly right now.

However, since you didn't prove that you are a US Citizen by sending copies of your birth certificate or passport it *could* mean that they will flat out deny you and you will have to start over rather than an RFE. Being a USC plus proof that you've met in the previous two years are the two most basic requirements of the petition.

I would call the USCIS number again next week to see if you can get an update. But keep in mind that they routinely provide incorrect information.

I would also read through the guides and flowchart at the top of the page as well as the government site here: http://travel.state.gov/visa/immigrants/ty...types_2994.html so you start to get a better understanding of everything involved in this process - it's long, slightly complicated and requires knowledge and patience.

I hope they did not flat out deny me.. I tried to read through the form i DL from the immigration site as best as I could. I dont recall it requiring me to send in my BC, but it does make sense; after reading this site apparently I was incorrect about that.

It's normal not to see a change in case status - some people never see a change even when they are approved.

What form i DL where you reading (not that it matters now). Once you have read through the guides and the travel.state.gov site, you will start understand a lot more about what's required here. You should also start reading up about all of the things you will need to send to your fiance, and what s/he will be required to do once the interview is scheduled. Good luck.
