Can you send the EAD before getting married?

That is if you came on the K1 visa.

11/2004 - Met in Brazil

09/2006 - Apply for K1

03/2007 - K1 approved

04/2007 - Apply for AOS & EAD

07/2007 - EAD approved

01/2008 - Conditional Residency approved

11/2009 - Apply to remove conditions

02/2010 - Permanent Residency approved

11/2010 - Apply for Citizenship

03/2011 - Citizenship approved

07/2011 - Moved back to Brazil

Yes, but if you do it will only be valid for 90 days after you entered the USA. Given that EADs generally take 90 days to be approved, it will run out before you get it most likely.

So the simple answer is really: no.

I know someone who arrive in the U.S. a day before my husband.

He's not getting married to his fiance for another 10 days but they've sent out for his EAD. Once he gets it, he can work?

We waited until last week to mail my husband's EAD because I didn't know we could have applied before we got married.

I hope we didn't waste time.

Apply for EAD without AOS, the EAD is only valid until the expiration of the I-94. Which is 90 days or about how long it takes to process an EAD. It doesnt make any sense.

Apply for EAD with AOS will allow the EAD to be valid for one full year.

That clears stuff up and I feel better.

Now my friend's fiance doesn't have an SSN yet.

If he were to get his EAD could he work w/out an SSN?

Those who enter the US on a K-1 visa are technically eligible for a temporary (90 day validity, same as K1visa) EAD, but it is no longer routinely issued at any POE, but New York's JFK. That EAD, yes you could have applied for before you were married, but since these applications take about 90 days to process, and the temp EAD is tied to the K1 visa, most people do not choose to apply for it (if they don't get it at POE) because more than likely they will either get a card that expires w/ in a week or is expired alltogether.

The 1 year EAD, you cannot apply for until after you are married and are Adjusting Status based on the marriage to a US citizen. So in your case, you likely mailed off an EAD application that may not be approved and sent to you before the 90 days are up on your visa...so that by the time you get it, it will be a non valid employment authorization. Was there a fee with your application....because I'm afraid that it may be money you spent for naught.....and it is money that you would probably have to spend again when you apply for the AOS.

Like I said - it wasn't us - but a friend.

We got married and then 2 days later mailed out the AOS/EAD packet. Now we're waiting for our NOA1s.

I thought we had done it the "best" way and I'm glad to see we waited to send out the AOS.

I was beginning to worry about talking to my friend, but everything is OK :thumbs:

I belive you can, but only if you have applied for an SSN. Once entered into the database (about 2 weeks after entry), you should get an SSN within 2-3 weeks of applying.
