Travel on ROC with Expired Greencard

Hi all -

I've seen a few old threads on this, and also a LOT of people questioning this in individual threads filing threads, so wanted to start a separate / updated thread on this. 

 

Is anyone who has traveled abroad recently with an expired greencard and extension letter able to share their experience? Was it good / bad / easy / hard?

 

My husband and I go to Costa Rica every year in November or December to visit our family there over the holidays. We will hopefully have had Biometrics by then (just received extension letter earlier this month) but by that time the greencard will be expired and I'm not hopeful we will have 10 year greencard by the pace of things. It sounds like it varies by airlines, but that the expired greencard and letter (ORIGINAL, NOT A COPY) should suffice. 

 

Can anyone chime in here?

I traveled last year and my green card was expired.. All they needed from me was my Passport, Extension Letter and My Expired green card. Had no problems at all.

 

Coming back is just a pain, because you don't get to use the kiosk by just swiping your Green Card, you have to fall in line where the officer takes a look at your documents. Had no problem there too. It was just the line that is a bit of an inconvenience.

Timeline

My family and I have traveled to the Dominican Republic and Ukraine on the extension letter.  We had no problems traversing Customs upon our return.

Now, my step-daughter, traveled alone, twice, back to Ukraine and upon her return they did take her to "THE ROOM" to review everything.  First time took a little bit, but the second time only about 10 minutes.  She had the letter and then, due to losing her green card, she has the I-551 stamp in her passport.  Overall, no obstacles incurred.

08/13/2018 - 18 months NOA received, dated 8/6/18

08/22/2018 - GC Expires

05/23/2019 - New Card is being produced! (11 months 1 week 3 days since receipt date)

05/30/2019 - Card Was Delivered

05/24/2019 - Earliest Accepted Filing Date for N-400.

08/30/2022 - Filed N-400 online, eligibility basis = GC holder > 5 years.

Oh lovely! Thank you, I will save that now and have it printed off ahead of time for us to bring with.

 

@Brian&Larissa + @curiousgeorgina thanks a million for the quick responses. I am happy the experiences have been positive so far, that is really reassuring. I didn't even think about the kiosk part (those things rock, last year when we went it was so smooth and I loved having hubby right along with me!), that stinks, but at least you got through easily. hopefully they will let me go in that line with him because I hate having to go through separate lines. we're together ya know. :) Would love to avoid "THE ROOM" though........

Bypass any kiosk and go straight to a desk. 

You will more than likely be escorted to ‘the room’ for a brief check to verify your status but you will be on your way quickly, as LPR and Citizens are dealt with ahead of non residents.

You are a permanent resident, so don’t worry too much.

 

As for going with your husband, you fill out one customs form per family, so should be in line together anyway. 

CR1 / DCF (London): 2012 / 2013 (4 months from I-130 petition to visa in hand)

I-751 #1- April 2015 [Denied]

 

April 2015 : I-751 Joint filing package sent fedex next day 09:00am from UK ($lots - thanks). 
Jan 2017: Notification that an interview has been scheduled at a local office. Bizarrely still no RFE... 
Jan 2017: 2hr wait, then interview terminated before it began, due to moving my ID to another state 2 wks prior. New interview 'in a few months...maybe.'   Informed them that divorce proceedings are underway, but not finalised at this time. 
March 2017: An Interview was scheduled - marked as no-show as they didn't actually send out a notification of interview. FML 
April  2017: Filed an official complaint with the ombudsman, and have requested Senator & Congressman assistance
August 2017: Interview - switched to a (finalised) divorce waiver. Told that decision will be made that afternoon, but no problems foreseen with my case. 
October 2017: Letter of Denial received - reason given as 'I-751 petition was not properly filed'. Discovered ex-spouse made false allegations to USCIS in 2015. No opportunity given to review & refute allegations  - contrary to USCIS policy.

I-751 #2 - Oct 2017 - Mar 2021[Denied] 

 

October 2017: Within 72hrs of receiving denial notice, a new waiver I-751, divorce decree & $680 cheque, sent to Vermont via FedEx overnight 9am priority.  
Dec 2019: Filed FOIA request for full A# file
Feb 2020: FOIA request completed - entire A# file received as a .PDF; 197 pages fully redacted, and 80 partially redacted. Don't waste your time!
March 2021: I-751 #2 denied for lack of evidence. No RFE, no interview, and evidence in previous I-751 not reviewed - contrary to policy. Huge errors in adjudication.

N-400 - Feb 2018 - Apr 2021 [Denied]

 

February 2018: N-400 filed online.  $725 paid to the USCIS paperwork wastage fund

February  2019: Interview - cancelled after a four hour wait due to 'missing paperwork' on their end. Promised Expedited reschedule.

March 2021: Interview letter received, strangely dated after I-751 denial. No I-751 interview conducted. N-400 interview and test passed, given 'cannot make a decision at this time' paper due to the ongoing I-751 nightmare...

April 2021: N-400 denial received citing recent I-751 denial as basis for ineligibility, even though it should have been a combo interview 🤯

I AM JACK'S COMPLETE LACK OF SURPRISE

Service Motion - March 2021 [Sent via FedEx & COMPLETELY IGNORED by USCIS]

 

March 2021: Service Motion request sent overnight addressed direectly to field office director, requesting urgent review and re-opening, based on errors in adjudication - citing USCIS policy, AFM and memorandums as basis for errors. This was completely ignored by USCIS.

 I-751 #3 - June 2021 - Jan 2024 [Denied]

 

IT'S GROUNDHOG DAY

June 2021: I-751 #3 (30+lbs/5000 pages of paperwork) & another $680 sent to USCIS via FedEx ($300+..thanks) .... 

June 2021: Receipt issued, card charged, biometrics waived, infopass scheduled for I-551 stamp number ten.....

Feb 2022: RFIE (no, not an RFE, a Request For Initial Evidence) received, for copies of the divorce paperwork that they already have 😑

July 2022: Infopass for I-551 stamp number eleven.....

August 2023: Infopass for I-551 stamp number twelve....

January 2024: Denial received, ignoring the overwhelming majority of the filing, abundance of evidence, and refutation of a provably false allegation. The denial also contradicts itself in multiple places, as if it was written by someone with an IQ <50.

HAPPY NEW YEAR

 

2024: FML. Seriously. I'm done.

my sister lost her green card but has the I-551 stamp (she was travelling with me), so she was sent with me to fall in line.. and we both didnt get to go to THE ROOM. I guess we were lucky.. 

 

Just go straight to the line and not the kiosk because what happened to me was I was sent to the kiosk and desk back and forth because one guy (works at the airport) keeps telling me i have a greencard and i should be in line at the kiosk.. and then the guy at the kiosk tells me to go to the desk because I have an expired green card. and it happend 3 times.. I had to look for a different guy working there to confirm where I should go. :D
