My application was send back to me, and asked to resubmit a new application with proper fee, my stepson can not be included in a join petition ( i put him in my wife's I751) because he didnt aquiere conditional resident status currently with his mother therefore he needs a separate petition . ., they come to New York the very same day ,together, same stamp date on boths passports so it was not reason to send it back to me .... ....so I don't know what to do because if I send a new application they may said that is to late because is pas the 2 year mark (may 28 was the 2 years mark) any help JC

They told you to resubmit, do that!

 

Stop speculating on what USCIS will do. You are not USCIS. You had already submitted on time, and they asked you to re-do it, so why are you wasting time here instead of first doing what they told you to do?

[01/10, 2018]  - DAY 001  (day 2149) (US Passport) Applied for US Passport, regular processing

01/25, 2018]  - DAY 015  (day 2164) (US Passport) Passport in hand (5 years, 11 months, 3 days from start of Journey.)

[06/14, 2013] - DAY 001 Mailed package to Chicago Lockbox via USPS overnight
[11/21, 2013] - Day 153 SSN and 10-year GC in hand

09/01, 2021]  - (day 3001) (US Passport) Passport in hand (8 years, 2 months, 18 days from start of Journey.)

They want me to submit 2 separate applications , one for my wife and one for my stepchild because they said that he didn't become a conditional resident at the same time that his mom 

thats wrong, he come to NYC for the first time with her  together so I don't understand why they said that he has to has a separate I751.  It it come to sending a separate application and fee , i will do it but a think that the make a mistake and you all know that they some times do.  Thanks for ur time

Do an infopass appointment fast if you think there is error. The thing is to do it quickly either the infopass or the two applications. Good Luck.
