Will UK battery warning aged 15 prevent B1 visa issue?

Hi,

My son had a police warning for battery after he lost his temper and assaulted me ( a shove against a wall and a kick that left a  bruise) when he was 15 in a one off incident he's now 21 with no further incidents.

my K1 visa application is in process to marry my American fiancé and now worried this will prevent my son from being able to get a visa and visit me in the US once I'm married.

he is a Uk government contractor and they didn't think it serious enough to deny him working for them but will it stop him visiting me in America?

He won't know until he applies. We don't know either. 

 

If he got arrested he will need to mention that in the visa application and bring paperwork with him to the interview. 

 

Not eligible for vwp?

We don't know if he is is eligible for VWP yet he hasn't tried. Guess he could try and find out. Uk law says a warning isn't a criminal conviction but it does appear on his ACRO police report.

 

have checked VWP eligibility questions and it wasn't "SERIOUS" harm to another person so he doesn't have to declare it.

He's from a VWP eligible country and hasn't actually tried to use it, and you believe he will get a visit visa? I think I would try utilizing the VWP first, it might be tricky to convince a CO to approve a visit visa, without knowing access to the VWP is cut off. Before travel the ESTA will have to be filled out and all questions answered honestly, that would let you know if a denial would result.

 

A UK friend of mine could no longer use the VWP, because of the administration's policy regarding certain countries she had traveled to. This flagged her on the ESTA. She successfully applied for a visit visa, however she had a lot of proof of ties to home. Your son will also have to overcome that as well. If he has something that's flagged on ACRO, he'll have to order a SAR from them, and also bring any documentation relevant to the case.
