AOS interview successful, but waiting for FBI name check

as much as i hate to add my family to the list...our AOS interview was june 29th 2006...all was okay, only awaiting fbi...our senators office has confirmed our waiting status...all we can do is wait...

Still waiting since 7-2004. Interview was 2-2006. Did Infopass 1-2007 and still waiting on Namecheck.

Congressman did an inquiry and said there was nothing they could do.

Filed for EAD Renewal 12-2006.

AOS interview 2-16-2006

Told that AOS approved "Pending Name Check"

Refiled for EAD 12-12-2006

I have written both Senators of my state with no luck.

I have written my district congressman with no luck.

They all say it is out of their hands.

I even wrote GW Bush a letter asking for help , but got no reply.

Sorry if I missed this somewhere in the last several pages - but I remember reading somewhere that they were supposedly going to stop interviewing people (for AOS) who had not yet gotten their FBI clearance.

I take it that isn't true?

Yup, I had AOS interview last week and FBI check not completed as of yet. At first AO said he will take our I94 stamp, and I was sure FBI check was o.k., and then he looked at the papers and started explaining about it, which I was already familiar through VJ and was most dreading to happen.

Anyways, he didn't take I94 and I joined the "waiting club"

how does this "name check" happen? Does it also apply for k1 adjusting their status? What if I have my nbi clearance back home from phils (got expired already last feb1 past 1 year) will they still check me? And lastly, how do we avoid it?

I hope somebody can clarify this to me. Thank you very much.

then again, there have been a few people who were turned away from their cancelled AOS interviews citing no interview until check is complete. It just depends on who, where, when, etc.

AND people who have their interview cancelled, then get denied for not going to the interview. :blink:

namecheck applies to all adjustment of status AFAIK, and any previous clearances do not have any bearing. There is no avoiding it, as it is a requirement, although something like 90% are completed in 30 days, 60 days and so on. A very small % (comparatively) get *stuck*. Everything else just seems like speculation.

Yes, it applies to K1 applicants also. This FBI check is more detailed than the check we had to have for K1 visa. You can't avoid it, everyone goes through it. All you can do is hope that yours is completed prior to the interview. Good luck.

I was told at the interview that they check every country where the applicant has lived, AO also said that it sometimes depends on how fast they get info back from those countries.

You were misinformed. There are several checks that USCIS does to check into your background, and they are detailed in this document:

You'll note that none of the checks they do involve asking foreign governments for background information.
