AOS interview successful, but waiting for FBI name check

Thanks for adding me Laura, this thread is great! (in a sad way ;) )

I've read thru all 24 pages (took 2 cups of coffee) to try and see why this has happened. I'm not complaining or freaking out (yet) since the interview was only yesterday, I'm just trying to understand and see any similarities.

AOS filed: May 15

Biometrics: June 13

In the elevator the IO asked me if I had my biometrics yet, I told him yes and the date/city and showed him my appointment notice which I just happened to bring with me. As soon as we got to his office he went to his computer and printed something out. Towards the end of the interview he showed me what he printed, it was the FBI request. The request was submitted June 1 (before my biometrics) and there was a 2nd date of June 9, I couldn't see what that date was for.

The July 17th "now processing" dates for an I-485 in San Antonio are May 20.

Is the above similar to others that are pending? I think the only one I caught that had a FBI request before biometrics was chanelkitten.

According to our interviewing officer you can! She took my I-94, but left me my EAD and AP and said I was free to work and travel while the name checks were pending... I think technically your AOS is still pending during the checks, and that's the time frame AP is for.

thanks for the reply, We were told it was ok to travel too... they did take my I-94 but I believe you get a new one when you enter with AP.

Forgot to ask if it makes a differnce whether it is for business or family purposes. I think you are right that while FBI name check is being conducted, your AOS case is still conisidered pending. I just wanted to make sure by asking fellow VJers if they have had any problems traveling while pending name check. It would be a horrible thing if you get stuck coming back in... after the long k-1/AOS journey so far!

we are traveling on athony's AP right now. when we left the country, the girl asked for his I-94 at the gate prior to boarding the airplane. he explained to her that the immigration officer had taken it out of his passport during our interview, to which she replied, 'what interview?' :blink:

then she sort of shrugged, and waved us through.

we'll be re-entering the US on Sept. 9. we had an infopass appointment last week, and we verified at that time that travel on AP was still perfectly fine.

Well...I'm here to join this thread! We had our AOS interview this morning in Miami...and of course approved pending the FBI check. From my understanding there's a law that states the FBI check needs to be completed before the interview. We'll give it some time, and then see what kind of action will need to take place in the coming weeks/months.

December 8, 2005 - Married!

January 20th - TSC recieves AOS packet along with EAD petition

January 24th - Recieved NOA1 for AOS and EAD

February 15 - RFE for I-485...request another copy of birth certificates.

March 9, 2006 - Notice that the RFE Documents were received by USCIS

March 10, 14, and 15th 2006 - I-485 TOUCHED!!!

March 23, 2006 - Recieved Biometrics appointment for April 14th for AOS/EAD!!

April 14, 2006 - I-485 and I-765 TOUCHED!! April 18, 2006 - I-485/AOS - TOUCHED!

April 20, 2006 - I-765/EAD APPROVED!! (90th day!) April 24, 2006 - EAD card ARRIVED!!!

April 25, 2006 - Went to apply for SSN...told to come back May 12th!?!

June 9, 2006 - Hubby received Social Security Card! - July 19, 2006 - AOS Touched!

July 28, 2006 - Received Interview Letter! Interview is August 24th - 9:30am

August 24, 2006 - Interview. Approved pending infamous FBI check...

September 27, 2006 - Received welcome letter!

September 30, 2006 - Rcv'd e-mail (3) that the green card has been ordered.

October 5, 2006 - Green card received with error!!!

October 6, 2006 - Sent I-90 form - they received it October 10, 2006

November 17, 2006 - Infopass...received temp I-551 stamp good for one year.

December 19, 2006 - Received corrected green card!

July 1, 2008 - Mailed I-751 to Texas Service Center

July 3, 2008 - TSC received I-751 packet....the wait begins!

July 9, 2008 - TSC cashed I-751 check.

July 12, 2008 - Recieved NOA1 - 1 year extension letter. - July 30, 2008 - Rcv'd Biometric Appt for 8/21/08

April 13, 2009 - Recieved approval for 10 year green card!!

I have written my district congressman with no luck.

They all say it is out of their hands.

I even wrote GW Bush a letter asking for help , but got no reply.

That's pretty typical behavior really.

USCIS/DOS/DHS/CBP - all VERY separate entities whose employees by and large have no idea what the others day-to-day processes are. They have an overall idea of what each other does, but not the meat and potatoes.

I watched last fall while two CBP officers watched meekly while waiting on permission from DHS security screeners to pass through that area. Was funny as CBP officers have MUCH more authority, but not on that particular turf.

AOS filed 7-2004, namecheck started 10-2004, 2-2005 had fingerprints done (biometrics), 2-2006 had interview, passed interview but having to wait due to "Namecheck Hell"
