Hi, Iam really appreciated if you can help me with these questions about the Form I-164

 

PART 5 sponsor household size, in this part how much would be the total that I must place, if by default it is already 1 in item 2 "yourself" and there are 1 more because I am the immigrant, but I am also the wife,

then I must place one more where it says "If you are currently married enter 1 for your spouse, additional to that we have our join sponsor, but he has not filled the form 1.164A because they told us that you only have to fill the form I-164 and my husband (petitioner) another form I-164. 

 

PART 6 Sponsor employment and income, in this part my husband (the petitioner) has been living in Peru for 1 year, (Abril 1017-abril2018) so he has the taxes of 2016 as the most recent, since those of 2017 have not yet come out, so his three taxes of the more recent years would be 2016, 2015,2014?

 

PART 6 - Income you are using from any other person ... Should you place the name of your brother-in-law who is the join sponsor there, even though your brother-in-law was not included in the Household of part 5 because he did not fill out the I-164A format? Or should you still place the name by sharing the income with him?

First thing: it’s probably a typo (164 for 864 in your post)

 

Part 5: you would put 0 on where it says “if you are currently married enter 1” since you, the spouse is the intending immigrant already counted earlier. So total would be 2. 

Yout joint sponsor will fill i864. If that person is married and files tax return jointly, then his/her spouse might need to fill in i865A. 

 

Part 6: 2017 is needed aince it’s already past the tax deadline. You don’t need to necessarily get the tax return from IRS, copies of whatever is sent to IRS along with W2 is fine. Same thing with joint sponsor.

 

Part 6: Does the brother in law lives in the same household? If not, income shouldnot be inlcuded in “income from other person”. Yout brother in law will fill in separate i864 and provide tax documents or transcripts and proof of current income separately.

2016-07-06: DS-260 Submitted

2016-07-07: AOS and IV Package mailed

2016-07-08: NVC Scan

2016-08-08: Case Complete

2017-06-30: Interview, approved

2017-07-04: Visa in hand

2017-08-01: Entry to US
