Hi there to everyone,

 

Greetings! 

 

  My US husband file for my son who is 17 years old for an  IR-visa last December . Now I am concern about my son's birth certificate because I indicate his dad as a father and sign the birth certificate  (previous relationship) . I have no contact the father of my son 's since he was born , he abandon us and never support financially .  Do  my son have trouble in  coming to the US  or for his interview at the US consulate  ? 

 

Any help very much appreciated.

That does not sound like a birth certificate issue, because you HAVE and accurate one available to you.  If your child was born in the Philippines and you were not married to the father at that time, the father has no rights, so you don't need his permission for your son to immigrate to the US.

 

If you did not provide a copy of the child's birth certificate with the petition, they will be asking for it before approving the petition.  If you lied about who the father is on the petition, chances are your son will never be coming to the US at all.  That could be considered a material misrepresentation.

There is nothing in my post about court docs.  Perhaps you read it before I noticed Philippines.  If you weren't married to the father when the child was born, you need nothing more than the birth certificate and a CENOMAR that indicates you weren't married to the father.
