Hello,

 

I filed for my AOS from a K1 in March of last year and I received an interview notice today. The interview is scheduled for March 20th (not much notice, unfortunately).

 

The papers I received state the following:

 

"You must bring the following documents, only if they have not been previously submitted:

 

A current (within 1 year) Medical Examination, Form I-693 and Supplement Form I-693 (if not previously submitted or if no longer valid) performed by a doctor in the list of USCIS authorized physicians found at www.uscis.gov."

 

I had previously submitted these documents. However, the medical exam was performed in December, 2016. So, it is outside of a year currently.

 

Do I have to schedule a new medical exam where it's completely re-doing the original medical exam I had performed for my K1 interview? Having to go back for the exam with the doctor, blood work, x-ray.

 

Thanks for any help!

 

And if it matters, I still have the paper that I was given regarding my original medical exam showing that I had all my immunization shots and no medical disorders.

Do you happen to know of any good resource on this site that displays a list of everything that is a must have for the interview? The document I received from USCIS only specifies a must have for the medical forms and suggests to bring supporting evidence of marriage. However, I've seen other threads on here with people stating that you must bring the NOA's and other documents.

 

Thanks for any additional help.

Thanks, I'll take a look. And yes, the interview came at a terrible time. I'm currently outside the US and have to abruptly return with little notice and get my medical done and everything in order.

If you filed your AOS within one year of the medical then you do NOT NEED to see a civil surgeon.
The medical does NOT expire for AOS purposes after 6 months.
It is not 1 year from the medical to when you are asked for an interview but when you filed and submitted your AOS.

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

If the DS3025 was marked complete and AOS was filed within one year of the medical then no need to see the CS.
The medical does NOT expire after 6 months for AOS purposes after entry.
OP has submitted AOS 3 months after the medical.

The letter that I received from them, someone from immigration specifically used a highlighter to highlight this part of the paper:

 

"A current (within 1 year) Medical Examination, Form I-693 and Supplement Form I-693 (if not previously submitted or if no longer valid) performed by a doctor in the list of USCIS authorized physicians found at www.uscis.gov."

 

I was concerned about the wording stating "A current (within 1 year)" and with them highlighting it, and now have further confusion with two people stating separate information on this thread. Although, I appreciate both sets of feedback.

 

I'm currently outside the US and was only originally planning to return in several weeks. So, this came fairly abruptly with little notice and I was planning to call to inquire about a doctor's appointment tomorrow for the exam and fly back to the US as soon as possible for the exam. But, if it definitely isn't needed then it will save me time and money. I was planning to call USCIS as well tomorrow but wasn't sure how knowledgeable the general call center employees were on specific details like this.

You can also take with you the instructions that a complete and submitted within 1 year medical 

is not required for a K1.

Some newbie IO may not know this and a call to USCIS would be useless. This comes up several times a week here.

I checked out the pinned post in the AOS forum. It says that a new medical is not needed if the AOS was submitted within a year of the medical. Is this still the case even though my AOS was filed within a year but not actually interviewed or adjudicated?

 

My timeline was: 1) Medical completed in December, 2016......2) Sealed medical documents from doctor brought to K1 Visa interview.....3) At the interview, they gave me a single piece of paper. I'm not sure if this has a specific file name, but at the top of it it says "Vaccination Document Worksheet.".....4) I filed for AOS of status in March, 2017......5) Received interview date for March, 20, 2018.

 

When I submitted my application for Adjustment of Status, I didn't submit a I-693 with that specific application, just a copy of the Vaccination Document Worksheet. I don't believe a I-693 was required to file for AOS since I was doing so a few months after my medical and two months after my K1 interview.

 

So, based on all that information, I'm still good to go? I was mainly concerned since someone from immigration specifically highlighted the medical part in yellow.

 

Also, you had mentioned about bringing in the instructions. I found this page on the USCIS website: https://www.uscis.gov/policymanual/HTML/PolicyManual-Volume8-PartB-Chapter3.html

 

Section 4 of that page states:

 

K and V nonimmigrants applying for adjustment of status are not required to repeat the medical examination if the application was filed within one year of the date of the original medical examination, and:

 

The medical examination did not reveal a Class A medical condition; or

The applicant received a conditional waiver in conjunction with the K or V nonimmigrant visa or the change of status to V and the applicant submits evidence of compliance with the waiver terms and conditions.

 

Is this the instruction you were referring to?

Yes, it always helps to be thorough when posting. Previously I looked up your timeline and based my answer on that.
Yes, you are still ok because you submitted AOS 3 months after the medical. Even if a case is not adjudicated after one year, all that matters is that 
it was received within one year and yours was 3 months.
Yes, those are the instructions. 
Here it mentions the one year policy but it gets confusing because in this link it again mentions the I-693, so disregard for K1.

Different regulations for different visa types/applications.
Our AOS took 2.5 years to be approved. We submitted the AOS within 7 months of the medical. Never were asked for another medical.
Some newbie IO's will ask for it or send a general template letter on what to bring. 
You can bring the instructions as I said and if still not accepted then you get another medical done even though it is not needed
but you do it to get it over with and approved. You have the right to kindly ask the IO to check with his supervisor though if he just doesn't
get it.
