Wow congratulations !

 

That was incredibly fast.  I've had my GC for almost 10 years but filing under VAWA.  Can you just bring copies of the  1040's I have filed over the last five years or does it have to specifically be tax transcripts? I have just filed our recent one, and I'm not sure if the transcript will be in the IRS system yet. It was accepted and we received a refund.

You *can* bring copies of the *entire* tax filing...but honestly USCIS prefers tax transcripts because they are usually just a few pages long for each year and all the information they need on it is laid out for them straightforwardly.    In some cases, the tax transcripts aren't even looked at when filing under the 5 year rule...depends on the IO you get at your interview and how stringent they want to be.   If you've had your GC for 10 years, you're eligible to file under the 5-year residency rule and won't be adjudicated based on your previous marriage/VAWA filing at all.  (the IO may ask you questions regarding your previous marriage just to determine you received your initial green card properly, but they won't hold the divorce/prior marriage against you unless they determine it was fraudulent.)

Thanks for getting back to me. I thought the Tax transcripts would be preferred. I was advised by Sandraj to file as a VAWA recipient under 319a even though I've had my card almost 10 years. To be honest, I think it would be easier not to, but she has an excellent reputation on here and is an attorney.

 

I wonder if anyone has successfully gained Citizenship using the 5 year rule as opposed to 319a after a successful VAWA petition and AOS? Do you have any idea?

 

I have to file before March 7th as I don't want to have to apply for Green Card as well, since it costs so much.

Hi everyone! 

Hope you having a great summer. 

I am successful VAWA case and today I had the interview for citizenship. 

I did great on the history test ( answered all questions) also passed the writing and speaking test.

However the officer was asking me again about my marriage and few details about it. 

Is this normal? I did not expect to be questioned again. I have nothing to hide, and I gave the answers, however he was asking me dates and I have forgot some since my marriage was 6 years ago. 

The officer was a male and he wasnt really nice, but very formal which is OK but makes me thinking he is strict and can do something about my aplication. 

 

He said a decision will be made in 4-6 weeks. I thought this is a formal interview and now I am confused. 

Please if someone has passed interview recently share your experience with me.

He asked, how did I get the green card and if I can tell more about it. Also he asked when did I met my ex. Was there police ever called? and the rest were from the N400 form

Thanks so much for your reply. My VAWA petition was filed in 2005 and approved in 2007. I finally got my Green Card in September 2008. I have tried so hard to put it behind me and can’t really remember lots of dates. It’s upsetting to talk about even after all this time. Thank you for your good luck wishes.
