Hey all, so I had a letter today from USCIS requesting for more information. Its seeming that its all extra information for the 1-864 however I know that I put everything in the package that they asked for, so I dunno I'm kinda confused. I'm not sure if its because we put my father in law and my husband as a joint sponsor? Anyone had anything similar? 

 

Also I was wondering if this will effect the time it takes me to get travel document and work authorisation permit or if they are processed separately as they are separate documents?

It won't let me load the pics, i just tried it said file is too big. So this is what it says we need to do:

- The sponsors household size on the petitioners form i-864 affidavit of support ( Revision date 07/02/15) was calculated incorrectly or not completed. A household size of o or 1 is not acceptable. the petitioner/ sponsor must correct / complete this and return page 4 of form 1-864. 

-Submit all supporting tax documents (W2s, 1099s, form 2555 and all supporting document, submitted to the internal revenue service for the most recent tax year. the joint sponsor must submit all supporting tax documents for the most recent tax year. 

- Based on the documents submitted with the form i864, for the joint sponsor, the income did not meet 125% of the poverty line for the joint sponsor household size. submit evidence of assists that meet the standards listed below or obtain a different joint sponsor. 

 

 

So I'm confused. Because my husband was in England with me last year so didn't work in the US, hence why we used his dad as an additional sponsor. His dad lives alone in Georgia (So when it says a household of 1 is not acceptable, I'm not too sure). he earns 55k a year which is well above the GA poverty line. I'm so confused, is there a number that I can call to speak to someone to get more information. Also we defiantly sent W2s for the last 5 years, a letter from his bank saying how much money goes in every month etc, letter from his job etc. The only thing I think it can be is that my husband and I moved to Florida (So will that affect the decision because were not in the same household?), my husband just found a job but when we filed he was just down as a student becausee he wasn't working at that time. I;m not sure if this is making sense, I'm so confused. Is there a number i can call them on?

Based on your description, this is what needs to be sent. I would basically start over rather than sending a page 4 by itself.

 

Your husband

  1. New form  I-864. Make sure page 4 household size has item 1 (1), item 2 (1), item 8 (2)
  2. His 2016 tax transcript (download or order by mail from IRS)

 

Your father-in-law

  1. New form  I-864. Make sure page 4 household size has item 1 (1), item 2 (1), item 8 (2)
  2. His 2016 tax transcript (download or order by mail from IRS)
  3. Proof of his US citizenship (photocopy of birth certificate or passport 

 

If you use a tax return transcript, then you don't need all the schedules and W2s. The fact that you sent W2s for five years shows you didn't follow the instructions. If you don't get the form or income tax documentation exactly right, they will just say he doesn't qualify. It's not because his $55k salary isn't enough. It's because without the exact documentation needed from the joint sponsor, they ignore his application as not qualified. 

 

Note on page 4 Household size:

The household size always includes the immigrant being sponsored.

Husband + you = 2 household size on his I-864

Father-in-law + you = 2 household size on his  I-864

I noticed in your other thread that your husband is now employed. Add new address and his new job to his re-do I-864. If he is over the poverty level at the new job, you don't need a joint sponsor.

 

Revised for husband:

  1. New form  I-864. Make sure page 4 household size has item 1 (1), item 2 (1), item 8 (2)
  2. His 2016 tax transcript (download or order by mail from IRS)
  3. Employer letter from new job.
