SO can you go to the US with just a I 130??

I am REALLY confused. Once we get this I-130 can we then move to the States, or do we have to do this Pack 3 I keep reading about?

Once your I-130 is approved, you go to the next step : the immigrant visa........ you will get instructions from the embassy.

it is no way you can speed up the process...we all suffer here

NO, you need a visa to immigrant to the USA (CR-1, or IR-1)

The only to speed it up a bit, is to file I-129F after receiving the receipt notice for the I-130 this will start a K-3 visa process. K3 only is available when the I-130 is filed in the USA, not if filed at the consulate for DCF. DCF is by far the quickest method.

In our case we had to wait 8 months start to finish, and wished we were working with a quicker consulate like London with DCF

I'm not clear on your details.. would you please tell us who is who, and where you filed your I-130?

The I-130 is a petition, and no, it is not enough to move to the US with. You need an immigrant visa.

The I-130 is a petition. Think of it like a request to allow the non-US spouse to have the honor of interviewing for an immigrant visa. Once the petition is approved, there are many, many steps and a long process to follow before an immigrant visa is issued.

It is very possible by August to get your visa. Meanwhile you should start to get together some documents you need: police certificates from every place you lived more than 6 months since you 16 years old....

Since your husband is a USC your children are automatically US citizens once that is taken care of, so they will be able to be here in August. As far as your visa, I think it will be very hard for it to be processed in about 3 months to be honest with you, it could happen though. But it's not like you file, get approved and get to fly out here within a month. It takes time and lots of patience.

So you are doing a process known as Direct Consular Filing; read the Guide from "OK, Ready To File" on.

You can look for the required documents in the Embassy Info link in the blue bar, top of the page.

You can read other London expereinces in this forum, and the IR/CR forum here--the main difference is that everything that those folk submit to the 'NVC', you will submit directly to the Consulate at your interview.

The kids need to get their US passports squared away (and UK) if you haven't done so yet.

Dave will want to start looking at the Affidavit of Support I-864 and getting his tax return docs and financial info ready.

Typical cases are concluded in about 6 months (I-130--->visa)--there is no set timeline.

Thanks this is really helpful. Two of the children are dual nationality and have there passport already. The eldest is my son, Dave's adopted son, so we've been told once he's on US land he can have dual, but we have filed I-130 for him too

Good job on the I-130 for the kidlet, Tracy, and you're right. He'll get an upgrade at entry.
