Hi Guys, so I'm about to submit my N400, but I'm still not quite sure about one of the requirements which states "You have lived within the state or USCIS district where you claim residence for at least 3 months prior to filing" The thing is, I recently moved from Southern California to Northern California from August to December. I just arrived back to Socal a few days ago and I'm about to file my form N400 from Socal, does me being up north and only recently coming back down to Socal breach this requirement? 

 

I'm little confused about the wording, it sounds to me that as long as an individual stays within the same state that he or she is applying then she should be good right? I don't get the point of the latter part of the requirement.

California has FOUR different USCIS districts so you have to be a resident in that specific district for 3 months BEFORE you can file.

  • NOA1 in mail 06/13/2007 (who said 13 is badluck )
  • 07/30/2007 After no touches and no other signs we just got an email with the APPROVAL of I130....Thank God !....now what ?

  • 08/07/2007 Case received by NVC and case number assigned :))

  • 08/13/2007 DS3032 and AOS bill were generated

  • 08/14/2007 Emailed choice of agent ...i'm so curious when they will accept it...hopefully soon

  • 08/21/2007 DS3032 and AOS fee bill arive in mail

  • 08/27/2007 paid AOS fee bill
  • 8/28/2007 DS3032 choice of agent accepted
  • 9/3/2007 IV fee bill generated

Each district is served by different local offices where you would be interviewed - If you cannot show residence within that district they cannot interview you.

They will reject you based on residency ineligibility.

That's a bummer, I thought from the wording "you have lived within the state OR USCIS district.."  that I only need to satisfy either requirement. 

 

The thing is I moved away for school and I'm moving back to the same address before I left I don't know if this makes my case special.

unfortunately nothing makes anyone special with USCIS ....

 

The OR in this case is inclusive for the requirements to clarify that states may have multiple USCIS districts.

You are total right candybaby,  so I just spoke with USCIS customer service and the agent told me that since I moved to a different district and started renting another place this does break the 3 months rule. She advised me to wait another 3 months before applying
