I am an American citizen and my wife is Filipino. We were married on October 28th, 2017. We are in the process of submitting our CR1 spousal visa petition. I understand the process is quite long and we both would like for her to be able to visit me here in the US while we are waiting for the CR1 petition to get processed/approved. Do we stand a chance of her getting approved for a US tourist visa? Or would we just be wasting our time and money by applying? She isn't currently working, so she has no real ties to her home country. The only thing that would keep her returning to the Philippines is the fear that our CR1 visa petition would get denied. We really want to see each other, but we understand that it will be difficult, if not impossible for her to acquire a US tourist visa. I could use some advice/guidance on this. Thank you in advance.

Getting a tourist visa from the Philippines is not simple in itself, and having essentially no ties home and a USC boyfriend + pending immigrant petition is almost a guaranteed refusal. Sorry, but that's really the way it is. She is free to apply...the only thing to lose is the $160 fee. But by the sounds of it, she has a pretty poor case in a country with a high refusal rate already.

 

The I-130 wouldn't be denied if she decided to stay in the US anyway. It would not even be impacted (although an overstay of 180+ days would result in bar if she left the US).

If the only cost of her applying is the $160 fee then she can apply.  There is no negative impact on her spousal Visa application for doing so as long as she tells the truth, the whole truth and nothing but the truth at her tourist interview.  If she would have to take a flight to go to the US Embassy in Manila or a long travel from someplace on Luzon then it is likely not worth it since as stated above based on what you've provided her chances of it being granted are practically zero.   Otherwise you'll be looking at flying to the Philippines to visit her or her and you both flying somewhere else to meet and spend time together.   Do note that if she is going to leave the Philippines that unlike some countries there is no guarantee that the Philippines would let her leave.  And do be aware that a CFO seminar is in her future even if she wants to change her name to her married name on her passport.

Chances of obtaining a visitor visa are none and less than none.  Don't waste the time and money.
