As for the affidavit of lieu legal capacity to contract marriage, yes I got that in 1 hour. That is not a problem at all as long as you have an appointment. Your real worry should be getting back to your province as soon as possible after getting the affidavit so that you can apply for license. That's also why making sure that you have everything that you will need when you get to your local civil registar in Ormoc. Also find out when they perform civil ceremonies. My wife's municipal only performs them on Wednesdays.

Actually a foreigner can get a CENOMAR and some cities require it as they do NOT accept the Affidavit from the embassy.

I did not know that. It seems rather odd since a foreigner would more than likely not have any record of marriage in the Philippines. However I do know that every city municipality is different and some had a problem with the affidavit. There is no uniform way of doing things there that's why I always suggest checking with the local registar. Thank you for clearing it up :)

Odd.. ?  Not really.  You were married in the Philippines, if you were to go to PSA and requested a CENOMAR they would issue the CEMAR (Advisory of Marriage).  If I were to request a CENOMAR I too would get a CEMAR as we completed ROM after getting married in the USA.    Then someone new to the Philippines would be issued a CENOMAR as they have no record of being married.     The affidavit offers no proof of singleness .. as we all know.. people lie under oath at times.

 

In metro Manila, Quezon City stands out as a city that requires the CENOMAR of the foreigner.

 

Yes checking with the municipality where one plans to get married is the best route.

My fiancé did already she ask everything what requirements and she have auntie there at the local registers to help us she said we don't need to worry because her auntie was help about it... my fiancé had everything the only one thing is behalf myside the affidavit of lieu legal capacity to contract marriage thanks for info and godbless you  aloha

Well to me the whole process is odd. But not really when you consider it is the Philippines. Someone could have never been married in the Philippines and receive a CENOMAR. They can also be still married to someone and lie at the embassy to get an affidavit. Their checks and balances don't really do much, but oh well.

That will be a big help. My asawa having good friends and contacts at the local municipal made things a whole lot easier. Like I said on the affidavit, don't worry at all as it is a very fast and easy process.

The Philippines has many "oddities" that don't extend outside the country.

 

When I went to PSA to get a copy of our Marriage certificate, I had to complete a form that requires my middle name, when I got to the counter the guy sitting there asked me if my mother's maiden name was "John" .. serious.  They truly believe the middle naming convention of the Philippines is used throughout the world.

 

And yes a CENOMAR is no real proof of singleness anymore then an Affidavit is... except for citizens that have never left the country.   As you are aware from here on VJ there are many with foreign divorces that are not recognized in the Philippines that got their K-1 visas .. yet they have a CEMAR from PSA and not a CENOMAR.        ... Welcome to the Philippines.

 

And don't get me started on the lack of divorce in the Philippines.. where annulment is the only "road to freedom" (where did that come from? ;) )   And the process is costly, slow along with taking years.   I know a fair number that live with one person that they call their spouse, but legally are married to another ... yup that annulment things works great.

And the sad thing is many do not get married because of this and due to no child support laws or way of enforcing it, a lot of girls end up pregnant and alone, sometimes with multiple kids with multiple dads because they did not learn after the first one...

Yes that is waaaaaaaaaaaaay too common also.     

 

And where the filipina messes up with that many times is they "add a fathers name" so the child isn't branded illegitimate ... and that causes it own set of issues.

Filed at the embassy, you filed DCF?   Your husband is living in the Philippines at the moment?   DCF is very quick in comparison to filing in the USA
