Can the sponsored applicant use government assistance or public benefits?

If the sponsored immigrant uses federal means tested public benefits, the sponsor is responsible for repaying the cost of the benefits.

What are federal means tested public benefits?

Federal means tested public benefits are the following:

Food stamps

Supplemental Security Income (SSI)

Medicaid

Temporary Assistance for Needy Families (TANF)

State Child Health Insurance Program (CHIP)

What assistance programs are not considered means tested public benefit programs?

The following types of assistance are not considered means tested public benefits and do not have to be repaid by sponsor.

Emergency Medicaid

School lunches

Immunizations and treatment for communicable diseases

Student assistance to attend colleges and institutions of higher learning

Some kinds of foster care or adoption assistance

Job training programs

Head start

Short-term, non-cash emergency relief

I read this in one thread here, but I'd like to know if this information is correct. If I get a student loan to go back to studying, will my husband have to repay it or will I be able to complete the studies and pay it back as it's supposed to be?

http://www.uscis.gov/files/article/public_cfs.pdf It's not considered a public charge, so I don't see why he'd have to pay it back. Just like normal, when you graduate, or stop attending for 6 months, you have to pay it back anyways.

Public charge and subject to repayment from the sponsor are different things, from what I saw. Medicaid is not basis for public charge but it will be subject to repayment.

LPRs can get FAFSA student loans. The loan will be to the LPR, not to the husband, the LPR will be required to pay off the loan after studies are completed. FAFSA loans/aid is not considered a means tested benefit.

Right. That money is for LPRs and citizens, so it will be your loan. (Thinking of US law school by any chance?)

I'm going for paralegal 'cus despite going to law school I never really liked the idea of attending court. As a paralegal I can work on cases and write petitions without having to go to a courtroom. I like the office part of being a lawyer, not the court part.

LPR's can get all kinds of loans, but for some of them we may need a US citizen co-signer. Moreover, there are private loans that conditional LPR's are not eligible for But loans are not considered means-tested benefits, that's for sure.

I am thinking of starting a paralegal program too. And then, eventually, shoot for Law school...

Yeah, I also grew fond of immigration law, but when I got into law school in Brazil, actually, even before I started it, I wanted to take law to work with international law. I started thinking about it when I was 16. But in Brazil we don't go especific until a post grad or something similar, so I just have a bachelor's.

I have two years of speech-language pathology, that's it. I used to want to be a laywer but was like, too much school! Now I'm thinking of it again, but may stop at being a paralegal...depends on where life takes me, heh.

I might stop at paralegal myself, I've had enough years of study. 2 and half of Psycology and 5 of law. If I ever move back to Brazil then I can sit the bar and be a lawyer.
