I-751 and i-90

Good evening, I have a couple of questions and hope someone here can help me. 

I filled the i-751, was approved but i moved states and the 10 year green card was lost / stolen. I applied again with the i-90 on February 2017 and haven't received it yet. (Biometrics are done).

 

1) Does anyone know the processing times for this? 

 

 

Also, a little off topic, I got my first green card in January 2014, got divorced September 2016 (but got married August 2013 - so a little over 3 years married). 

When can I apply for citizenship? Is it just 5 years after having the first green card - so January 2019? (I have lived in here since April 2012).

If your ROC was already approved, then you don't need an I-751. You just need a replacement green card. The I-90 takes care of that. ETA for a replacement green card is anywhere from ~6 months to the better part of a year the last I saw.

 

Since you are divorced, you fall under the 5 year rule. The earliest you can apply for citizenship is 90 days prior the 5 year anniversary of your first green card: [January x, 2019 - 90 days]. When you got married doesn't impact the eligible date (even under the 3 year rule).

Yes, maybe I didn't explain myself well, I did file the I-90 for the replacement (I had been approved already). I don't understand why it takes so long even after I had been approved already.. 

 

About the citizenship, that's what I have been reading, including on the USCIS website, but an officer at the Tampa office told me I could file it already since I was married for 3 and had been living here since 2012. Completely wrong information that confused me.

You don't qualify for the 3 year rule.

 

From the USCIS website about the 3 year rule (general eligibility requirements)

• Have been living in marital union with the U.S. citizen spouse, who has been a U.S. citizen during all of such period, during the 3 years immediately preceding the date of filing the application and up until examination on the application

Yup, nothing is fast with immigration...not even getting a new piece of paper.

 

Not sure what he was going for, but you would definitely fall under the 5 year rule, which starts from the moment you first got your original green card ("Resident Since" as noted on the green card).
