Hello There,

 

I am in the process of preparing documents to submit i130 for both my mom and dad. I have not been able to locate a detailed post that lists the entire process from the start to end. Is there any post on this VJ Forum that I could refer to.


I have a bunch of questions that may be answered by that page

 

Some of my questions are

 

1. Where can i find a sample cover letter for my parent's i130

2. I understand, I have to file 2 separate i130s but need to know can they be mailed in 1 single envelope, can 1 combined money order be sent or needs to be separate

3. In terms of documentations, do I need both my mom and dad's birth certificate at the time of filing i130, or is it required at the later NVC stage

4. Additionally, my parents are from India and were born prior to 1969, therefore they don't have birth certificates, what document needs to be submitted in lieu of it and how to get that

11/15/16... I-130 packet received (Priority Date)

11/18/16... Checks cashed, received emails and text messages at 5:22pm, cases routed to Texas Service Center

02/22/17... NOA2 for Mom received (Notice Date 02/15/17)

02/28/17... NOA2 for Dad received (Notice Date 02/17/17)

03/01/17... Status online shows application sent to NVC 

03/17/17... Received emails from NVC for next steps!

03/21/17... Went online to Choose an Agent

03/28/17... Received emails from NVC confirming Agent selection and to proceed with the next step (paying fees!)

04/05/17... Paid the $120 Immigrant Visa Application Processing Fee online today (Also eligible to pay the $325 Fee but will wait before doing so...)

April-August... Took a break from the process in order to move back from USVI to mainland USA.

08/07/17... Paid the IV Fees for both my parents ($325 each) today

08/23/17... Called NVC because payment still showing "In Process", was advised to email proof of payment to have them manually correct it

08/24/17... CEAC website shows "Paid" and can now have parents' DS-260 forms filled in.

A_Singh: I am also in the same boat as you - need an answer for whether we need to send parent's birth certificate alongwith I-130. So I am hoping someone on this forum will confirm that. However, from my reading of I-130 instructions, I don't think we need to send parent's birth certificate. The evidence we need to send is as follows per my understanding and also what I am planning to send: (See below).  

 

Let's hope some good angel will respond to our question re. parent's birth certificate.

 

1.) Evidence of US Citizenship: copy of birth certificate, naturalization certificate, unexpired US passport, etc

- I am planning to send in copy of naturalization certificate and copy of unexpired US passport

 

2.) Evidence to prove family relationship: 

F. A mother: Submit a copy of your birth certificate showing your name and your mother’s name.

- I will send in a copy of my birth certificate and a certified translation of my birth certificate into English (might also get it notarized, but looks like that is not required). My birth certificate shows names of both parents. 

Note: I have an outstanding question re. my mother's name being shortened (Geeta instead of Geetali - which is the legal name). I am hoping that putting the shortened name in the Part 4 - 5a - 5c will help overcome this issue. 

 

G. A father: Submit a copy of your birth certificate showing the names of both parents. Also submit a copy of your
parents’ marriage certificate establishing that your father was married to your mother.

- I will send in a copy of my birth certificate and a certified translation of my birth certificate into English (might also get it notarized, but looks like that is not required). My birth certificate shows names of both parents. 

- I will send a copy of my parent's marriage certificate

 

I didnt see anywhere on I-130 form a requirement for parent's birth certificate. We will need it for later stages though. Like yours, my parents were born before 1969 as well and their births were not recorded. My mom has a school leaving certificate that has her birth of date (same issue with shortened name as above though) and my dad has an Age and Domicile certificate that shows his birth date. We will try and get his school leaving certificate, but not sure if we will be able to as you know how that goes in India. Can we let each other know what the results are of our process? I won't be starting the process until later this year though, but I will update here when I do. If you don't mind, perhaps you can do that same?

See above example I provided.

Separate, because they are 2 different applications, so you need 2 separate payments. Remember, just because they are mailed in one packet and a married couple, the paperwork could be processed by 2 different USCIS Agents - one for each application.

Yes, you need BOTH birth certificates, and YES you need them at filing. You will also need them later at NVC Stage too.

Some where on this thread, there are other posters asking the same thing, take a look through. I believe there is some documentation you could use, but I have no experience with this.

Hello Adar24.... you just answered your own question here my friend :)

 

YES You do need to provide Birth Certificates of mom, dad and you as the petitioner - this will not only prove their identity but also prove family relationship.

 

Everything you listed above is correct and should be sent with the initial I-130 applications.

Hi Deidre - thanks for the response. However, I am a bit confused now.

 

The I-130 instructions DO NOT specify sending in my mom's and dad's birth certificates to prove family relationship. It specifies that:

- MY birth certificate is required to prove family relationship with my mother  and

- MY birth certificate and my parent's MARRIAGE certificate is required to prove family relationship with my father.

Am I reading this incorrectly? I know we will need their birth certificates at a later stage, but not for I-130 approval.

Ahh I just re-read the instructions - Sorry, YES you are right, you need:

- MY birth certificate is required to prove family relationship with my mother  and

- MY birth certificate and my parent's MARRIAGE certificate is required to prove family relationship with my father.

I had submitted my parents birth certificate's in my packet (just incase) but also because my Mom was born in a different country :)

Thanks Deidre. With India, getting documents for very old events (such as parent's birth certificates) is a long and arduous process. That is why A_Singh and I are struggling to confirm that only the petitioner's BC will do for I-130. We will wait for someone from India who might have done this to confirm as well. Really appreciate your response - thanks! And good luck with your petitions.

Note: I have an outstanding question re. my mother's name being shortened (Geeta instead of Geetali - which is the legal name). I am hoping that putting the shortened name in the Part 4 - 5a - 5c will help overcome this issue. 

 

G. A father: Submit a copy of your birth certificate showing the names of both parents. Also submit a copy of your
parents’ marriage certificate establishing that your father was married to your mother.

- I will send in a copy of my birth certificate and a certified translation of my birth certificate into English (might also get it notarized, but looks like that is not required). My birth certificate shows names of both parents. 

- I will send a copy of my parent's marriage certificate

 

I didnt see anywhere on I-130 form a requirement for parent's birth certificate. We will need it for later stages though. Like yours, my parents were born before 1969 as well and their births were not recorded. My mom has a school leaving certificate that has her birth of date (same issue with shortened name as above though) and my dad has an Age and Domicile certificate that shows his birth date. We will try and get his school leaving certificate, but not sure if we will be able to as you know how that goes in India. Can we let each other know what the results are of our process? I won't be starting the process until later this year though, but I will update here when I do. If you don't mind, perhaps you can do that same?

Thank you! that is what I thought too. The i130 instructions don't ask for the parent's birth ceritificate right now therefore I am not planning to send it for now. I will send documentation related to that during the NVC stage. 

 

Also, you are right, for my parents I will be trying to get an affidavit made that they don't have their birth ceritificate. the US Embassy office in India has posted documentation that an affidavit from a senior family member can be accepted.

 

And oh yes, the name issue - my mom and dad both have the name issue (of aliases and wrong spelling) on theri school and college documents. so I believe the affidavit should suffice.

Hi A_Singh -- that sounds like a plan. Can you post the link to the US Embassy documentation re. a senior member affidavit. I might need that too. Thanks. Keep posting on status. We are planning to begin the process in mid-late Sep. So we should be a few weeks ahead/behind each other. Will be good to share experiences. Are your parents in Delhi? Mine will be going to medical in Mumbai.

Yes my parents are in Delhi, and I put down the US Consulate name on the form i130 as Delhi itself.
