Haiti extract of marriage CR-1

My wife and I are applying for the spouse visa. We want to send the application out right away, but we are not sure what constitutes the total marriage certificate that USCIS will approve. We have the act of marriage and applied for the extract paper; however, we only have the receipt from the extract showing that we applied. My mom was told by people in Haiti that this receipt paper can be used for emergencies such as opening a bank account, etc. What we need to know is will USCIS accept this paper together with the act of marriage until we actually get the extract paper. We have been told by two different people that we should get the extract in December 😞. We wanted to get the application in now so things can start processing, yet we don't want to lose $535 and have the application rejected for lack of required paperwork.

USCIS will require the actual marriage certificate, along with a certified translation if the document is not in English.  While your mom's friend in Haiti was trying to be helpful, applying for a regular spousal visa isn't considered an "emergency" for you to use just the invoice/receipt.  Is there anyway you can expedite the marriage certificate?

I don't think so but I will double check to make sure. Wow... I will pray it processes fast. Thanks for your comment

I responded assuming you know Haiti. In Haiti, there are two papers that equate the one marriage certificate paper here in America. They are the act of marriage and the extract marriage. We have the act of marriage and applied for the extract marriage. When we applied for the extract, that is when they gave us the receipt saying we could use it for emergencies or bank accounts etc.

If you married in Haiti, then that is something that you should have worked on getting immediately after the marriage. Depending on how busy they are, it could take a few days to weeks.

 

You need both the marriage certificate and the extract before sending it to USCIS. Once you have both, you will need a certified translation of both.

You will then send a copy of the marriage certificate and extract as well as a copy of the translation to USCIS. Of course, you need to make sure that you send your information as well as other documents that USCIS requires.

 

If your spouse is in Haiti, then she should be working on getting it. It should be at the Archives Nationales d'Haiti. Also, while you are at it, you should try to get your wife's birth certificate, which will be needed at the NVC stage.
