Hey all,

 

As I was putting together our I-751 and the proof for our bona fide marriage, I was a little worried to realize that we might not have enough. We have statements for bank/credit cards, phone bills, drivers licenses, etc. However, we don't currently have any health insurance, our car insurance is under my husbands mother's name, and we're currently living with my husband's family, so we don't have any rent or mortgage proof other than checks to his grandmother. We're a young couple, so a lot of these things we just don't have at the moment. 

 

This is the proof that we do have:
 

·         Copy of marriage certificate

·         Copy of a Deposit Account Balance Summary showing a joint bank account

·         Copies of monthly bank statements of our joint checking and savings accounts for 2015-2017 (most of 2015 being under husbands name, then included wife’s name Nov 2015), showing various financial co-mingling such as income, rent payments, bills, grocery shopping, etc.

·         Copy of our U.S. tax return for the year 2016 and a partial summary tax return for the year 2015.

·         Copy of cell phone plan information showing a joint account

·         Copy of joint cell phone bills for 2017

·         Copy of our Chase credit cards (Visa) showing a joint account

·         Copy of credit card statements from 2015-2017

·         Copies of mail/envelopes addressed to both of us, showing shared residence and public identification as a married couple over the course of the marriage

·         Copies of drivers licenses of wife and husband, showing a shared address

·         Copies of photos of us together at various events with family and friends throughout the years

Would the list of proof that we currently have be sufficient enough for us to not get an RFE? Should I be writing up a paper that explains our current living situation so they don't wonder why we don't have health/car insurance, or an official document for rent? I'm just hoping we won't run into any problems.

Don't explain in writing why you don't have what you don't have...just tends to confuse things more, and opens up avenues for lots more questions.  Instead concentrate on what you DO have to prove the validity of your marriage--and you have more than you think :)

 

As for the living arrangements, ask whomever owns the house to write a simple letter confirming that you live with them and that you pay rent.  The letter doesn't need to be notarized, but you can if you wish.

I would suggest submitting tax transcripts, rather than tax returns. USCIS prefers them and they are easy to request online and print out on the spot. As for the living-with-family situation, we lived with my in-laws when I first moved to the country for almost a year so I got a Rent Receipt template online, printed a bunch of blank copies, dated them one for each month that we lived there, and had my in-laws sign each one, verifying we paid X amount in cash. I submitted those along with our current apartment lease. I didn't say that they were my in-laws on the receipts, just had them sign in the "landlord's signature" spot like any other landlord.

I agree with the above post. We didn't have a lease or health insurance. Didn't bother explaining either because, why give them more reason to pry? 

Anyway, we got approved without RFE

11/13/13- Received NOAs for I-485 and I-765. No I-130?
11/18/13- Biometrics Appointment letter received
11/19/13- Successful biometrics walk in
11/27/13-Received RFE
12/16/13- Sent requested evidence
01/08/14- Case status changed to Testing and Interview
01/16/14-EAD received!

06/12/14- Interview. Approved on spot!
