Confused Dual Citizen for Infant (Filipino & US)

Hi Vj members,

 

My son got his PI (Philippine Passport) for the first time due to IR1 visa requirement and upon interview we where advice to go CRBA determination (since my husband is a USC). So we got Approved and recieved his US Passport from CRBA. By the way, his PI was returned to us without any note of Cancelled (due to determined as elligible of USC) So my question are....

 

1.) Does he acquire the dual citizenship?

2.) Do we still need to go to Phillipine Bureau of Immigration for ECC/ Exit Permit and fees? 

 

 

Need your help? Anyone here have the same case!?

she already had her Philippine passport... from what we were told , we would NOT NEED to goto Philippine Immigration to obtain exit clearance ..  BUT whenever we leave the country to come to the USA ,we would need to present BOTH passports to Philippine immigration....but enter USA on US passport only.

 

And YES holding both passports would make my daughter a Dual citizen..

1 December 2017 (Friday) : Sputum exam Completed and Vaccinations given . Ready for interview .

7 December 2017 (Thursday): Interview and approval

12 December 2017  (Tuesday): Passport with Visa ready to be picked at 2Go.

17 December 2017 (Sunday) : Flight and POE in USA..

24 August 2018 (Friday): AOS/EAD/AP packet in mail with USPS tracking number

4 September 2018 (Tuesday): Email and Text of USCIS Acceptance with 3  MSC # for all      (GC,EAD,AP)

8 September 2018 (Saturday):  Received our (3) NOA1 for (GC,EAD,AP)hard copy via mail

25 September 2018 (Tuesday) Biometrics Appointment

02 October 2018 (Tuesday): Case Status updated to Ready to Schedule Interview

28 January 2019: EAD/AP card approved

06 Feb 2019: EAD/AP combo received

09 May 2019: Interview

09 May 2019: 8 hours later Status changed to APPLICATION APPROVED..

14 May 2019: GREEN CARD ISSUED!!!

17 May 2019: GREEN CARD IN HAND!!!

22 March 2022 - NOA 1 received

15 July 2022 - notice of biometrics being re-used

21 March 2023 - received 48month extension letter

22 February 2024 - received text/email that new card is being produced. No interview.

07 March 2024 green card sent

Present both as you clear Immigration at the airport in the Philippines, even though I don't think the Philippines has a requirement for dual citizens.   The Philippine passport removes the ECC issue  ;)  so it has to be presented on exit.

 

For entry into the USA you must use the U.S. passport .. it's the law.

The Philippine passport was not cancelled as your son is a dual citizen by birth, he can always carry two passports.

 

1)  He acquired dual citizenship at birth as one or both parents are Philippine citizens.

 

2) NO.   Citizens do not need an ECC certificate.     

 

 

And as noted by others; for entry and exit to/from the USA the U.S. passport is required.   Philippines has no such requirement, the Philippine passport removed the need for the ECC when y'all leave and when returning to the Philippines it removed the need for a visa.. ;)

Hi Jtona, thanks and congrats to your daughter too...

 

All i need to secure now is my CFO. i'm still waiting on my Visa Packet though..hope it arrives next week... We already booked our flight end of this month...🙏🏼
