Thanks so much for the suggestions for the Smokey Mountains! It is very beautiful, but I live near it all and see it almost every weekend. My Fiancé would probably love it but then again he's lived in Montenegro for a while and they have gorgeous mountains there as well. I would love to do a typical all inclusive resort honeymoon, but all of those are mostly out of the country  :( But I do appreciate all the suggestions!! Thank you!

You are correct that the K1 is a one time entry use and is no longer valid after you enter the US. So you must get married within 90 days then after that you must adjust status (AOS) in order to gain permanent residency (green card aka GC). If you leave the US prior to having one of those two things, the beneficiary will have been deemed abandoned the process, be refused to reenter the US, and you will have to file a spousal visa for him which will take a year.

 

You really should take some time learn the entire process from beginning to end so you are not caught off guard moving forward. The K1 process is just the beginning. Next you get married and have  AOS. After that, in 2 years, he will have removal of Conditions which can be another stressful process. After that you have naturalization which is optional. Each of these steps require time, lots of evidence, and money.

Would you happen to know if we can get a marriage certificate a month after he gets here and start the AOS process and then have the actual ceremony in October? That way he may be able to get his AP and we would be able to travel outside of the country? I understand that the K1 process is only the beginning, the thing that I'm not sure of is what is permissible and what is not during all of those processes.

Sure,

 

The AOS is based on you actually getting married. So you will have to be officially married prior to filing AOS. I think what you are asking in the first question is to have a small courthouse marriage (official), then file AOS, then have a big (ceremonial) wedding later on. Yes, that is doable. The only issue with that is timing. If you apply for AP, which is the authorization for your fiance to leave the country while the AOS is pending, it may take 3 - 4 months to receive. You can certainly have your big wedding in October but to leave the US for a honeymoon you will need to wait for the AP. So say, for example, you got married this morning and send out everything today, it still could be until November that you receive AP.

 

As far as what is permissible. Until your fiance receives either his green card or EAD/AP he will not be able to work, leave the country, or in many cases obtain a driver's license.

 

EAD/AP are currently taking 3 - 4 months to receive after filing.

Green card, which is what he gets after he AOS is currently taking 6 - 9 months.

These times vary greatly.

oh and make sure he gets his SSN soon after he arrives (they say wait two weeks but with everything electronic he may be able to get it faster, like a few days after he arrives). It'll make his life a lot easier to have it (bank, insurance, etc), and there's a lot of stories of ppl who went to the SS office after getting married who got denied and had to wait until after getting EAD card.
