Hope somebody can help me answer my question. Last year I filled for my minor child who is now 18y/o this year. She's on f2a visa category. Yesterday, I found out that she is pregnant and about to give birth next month. I told her not get married and should remain single until she got here in the US. What will happen to her baby? Can she bring it with her? Or she should file her baby as soon as she got here? Thank you in advance for all your help.

Does she have someone to look after the child, is she willing to leave the child?

I believe the baby could be added as a derivative to the current petition.   Just had a few postings on this a few weeks ago.

I believe they can be added at the NVC or even embassy stage of the process without issue.

Thank you, will just wait for her visa to be current. Do we have to call or should we wait for her interview to tell them?

Need to wait until the child is born, have a PSA birth certificate... AND... passport

 

Here is some more information I found.

 

" Can my children also receive immigrant visas, even if they were not originally part of the case? - If the immigrant visa category in which you are applying includes derivative children, your qualified unmarried children under the age of 21 may be added as derivative applicants after your interview has been scheduled. Contact the U.S. Embassy or Consulate for specific instructions. At the interview, the additional applicant(s) will be required to pay the same fees and submit the same forms and supporting documents as you.  "

Well she could apply for re entry period and return, that would be good for 2 years by which time the childs visa number should be current.

Thank you this is so helpful. Immigration lawyer answered me back today and told me that as soon as I get the papers that need to forward to the embassy I should she should include the name of the child and be ready to show that you have a no marriage certificate and the birth certificate of the child. THank you so much.

IF the baby is born (and you have the PSA birth certificate) while still at the NVC processing stage, getting the derivative added at that time would be my thinking.

 

You do NOT forward documents to the embassy for the interview.. not how it is done in the Philippines.   So you will have to make contact with the embassy once the baby is born and there is a PSA birth certificate.  And for sure get the passport completed.

CENOMAR is a required document for the interview.. so the no marriage issue is covered.
