But I must say you filed your c9 application really late. Depending where you are, some USCIS officrs are super backlogged and may take them quite a while to grant your new EAD. I'm worried about it. I love my job. I guess I don't qualify for the 180-day extension. I do have a doctrate in a STEM field. Do you know if I can apply for the 180-day extension? Also, can I still keep my job if I go on unpaid leave?

@Hello_there You get the 180-day extension automatically when you “apply” for a student (c3B) visa and while that application is accepted but pending. Whether you can keep your job or not is between you and your employer.

 @milkypoochieThat's what is so unclear to me. I have an EAD card under c3B until end of January and I've applied for c9. Do I qualify for the 180-day extension?

@Hello_there Out of curiosity, are you Chinese? So if you read the earlier posts, it tells you that the automatic 180 days extension only applies when you renew the same visa, e.g., c3B to c3B. Although c9 to c3B is a renewal, they are different visas, thus you don’t get the 180 day extension. That’s why the owner of this post suggested applying for a c3B renewal alongside to qualify for extension.

@milkypoochie Thanks for your response, I didn't see it earlier. I'm from India. I thought there was no option to renew c3B. Is that right? I do have a STEM degree, so I will qualify for the c3C extension only if my employer is e-verified, which I doubt it. I will talk to HR and see.

@EMBELL_17 Thanks for your response! It looks like you got your NOA right away. My PD was Nov 14th. We called USCIS to expedite the process but they told us that they cannot move forward without the biometrics. I still haven't received my NOA. Any suggestions you have that could help? I see that you contacted a congressman. How does that work? Thanks a lot! I appreciate your feedback!

Oh, yes. I needed to get my biometrics before I could expedite. I just googled my local congressman. They usually have a representative who handles just this. Call them up and tell them - they'll know exactly what you mean. It's my understanding that congressman inquiries get pushed to the top by USCIS for review so I would definitely reach out. 

 

You dont seem to have been waiting that long though. I had to explain the urgency to the congressman and why it took me so long to send in my application.

Thanks! It looks like you got your biometrics done within 18/19 days, so I thought maybe there was a way to expedite my biometrics. It has been 23 days and i haven't received the notice to appear for the biometrics appointment. I will contact a local congressman/congresswoman. Thank you so much!
