Hi all, 

Im about to submit my I-751 application but it looks like I have to head back to my home country for 6-12 months. I don't think we will get approved for the current GC in time so I was wondering if its quicker to apply for citizneship while its pending?

If you are about to file the I-751 to remove condition on your 2 years green card, then you have at least another year before you qualify to file for US citizenship as the spouse of a US citizen under the 3 years rule.  Since you got your green card on May 13, 2015, you do not qualify to file for naturalization under the 3 years rule until Feb 13, 2018.  

 

If you leave the US for 6-12 months, you will not meet the physical presence requirement for US citizenship.

 

Review the requirements for US citizenship, there are several different requirements.

  • NOA1 for 130/765: 2/24/17
  • NOA1 for 485: 3/2/17
  • Biometrics letter: 3/11/17
  • Biometrics appointment: 3/30/17
  • EAD in production: 5/23/17
  • EAD received: 5/26/17
  • AP application received: 9/15/17 
  • AP application approved: 12/2/17 
  • Interview Notice received: 12/23/17
  • AOS Interview: 1/23/18
  • Approval email/texts: 2/8/18
  • Green Card mailed (hopefully): 2/14/18

So in the case that we are still waiting and the time that we are eligible to apply for citizenship comes around are we able to start the citizenship process while still waiting?
