Hello I need some assistance, I've been waiting to here back from the USCIS for over ayear now. And they won't give me information as to why my husband was denied his visa the first time from Nigeria and they keep saying that its normal.  Do i need to start over or continue to wait. Thanks in advance. :unsure: All I want is my husband here with me in the US.

I believe it will be like 5-6months at the USCIS stage. Good luck.

Honestly there is no timeframe. What timeframe you are referring to? This is how it goes. From the interview date to when USCIS sends you a NOIR(Notice of Intent to Revoke) or NOID (Notice of Intent to Deny) its 15 to 18 months. People who were interviewed January through March 2015 I just having their interviews. This is like 6 months prior sending in their evidence for the NOIR or NOID.

 

Refilling gains you nothing if you don't even know what you have against you. And they can deny you again for the very same thing if you refile. You have to be patient.

 

Two things will happen you will either get letter from USCIS once they review what the CO says and they reaffirm (stand behind their initial approval when you filed) and just send your petition back to the embassy.

 

Or they will send you a NOIR or NOID letter and you will get all the reasons the CO denied and you address with evidence all the denial points. Send back to USCIS they will review and they will either reaffirm you or deny you.

 

So just hang on and wait. They of course will not tell you over the phone why you were denied. And you may never know if you never get a NOIR or NOID. So just wait.

Please which type of visa do you apply for at the first. Did the both of you get married in Nigeria? Please let me know.

I can that the first advice is more ok because the person knows much about your case.

My husband & I got married in Nigeria 2013. & it was an I-130 petition was filed in the US. I appreciate the feedback. And i don't know anyone on here. All I want is my husband here with me. I appreciate the assistance.

That means you guys were denied at initial stage of USCIS. I believe you hired an attorney about your case or meet your congressman about your case. I pray that you find a way out. It is not easy. Just trust the Almighty Lord.

I had a lawyer when I first started in 2013 & now she just keeps telling me to wait & that they can't be rushed or I need ti start over. It will be 4yrs and we are still since May 2015 for an appeal. She (the lawyer) filed those papers I didn't know what had to be done.

It has been since May of 2015 since my husband has had his first interview & then we filed  for an appeal. She (the lawyer) filed those papers I didn't know what had to be done. Was something filed wrong, or the wrong papers filed? Im new at this so I. Don't know. This one is the updated response. Thanks

Was something filed wrong, or the wrong papers filed? Im new at this so I. Don't know.Yes when my husband told me the same day i immediately called the lawyer and told her and she said that she was goung to send in something to try & stop it from coming back to the us & stay in Nigeria. But whatever she did didn't work and wr have been waiting ever since. My husband and I will be married for 4yrs in july and we are still apart. I travel over when I can but its very expensive. But we are patiently waiting. -_-
