I-130 form question 59.a and 47 for CR1

Hi,

 

   Few things that I have been debating for a while. When I flew to my spouse in the Philippines, we stayed in an apartment for 1 month. This was for our civil wedding. Now in I-130 form question 59.a, it specifically asks for the address in which you "physically lived together". 

   In my I-130 package I have a copy of the apartment lease for 1 month in my spouse's name, as well as a picture in the apartment. What I have to consider is, I think I would have to include that in my addresses for the last 5 years section? Not sure if that would make it accurate any longer since it was only for 1 month. What do you guys think?

 

    Another thing is her passport. In question 47 it asks for a Passport No. and Travel Document No. Her current situation is that she is currently applying for a new one passport. Her current one is expiring in 2 months. Not to mention that it is still in her maiden name. Should I include this or should I put N/A. I've read somewhere that this would be refered to as the passport that she will use (if we are ever successful in the petition) to fly to the US.

 

I appreciate any thoughts or replies on this.

Even though you were there for a month, you were not technically living there, just visiting.  Visiting is not the same as living together so an appropriate answer for that question would be something like this, "we have not yet lived together."  "None" is also an appropriate response to this question.

 

List the passport information that is most current on the day you sign the form.  People have to update/change passports during this process all the time, it's no big deal.  When the time comes to complete forms for the NVC and have the interview at the Embassy, she will have her new passport with that information and that is what they will go by.

We got married in England which requires that you "live" there for at least 7 full days prior to the date of the ceremony so we simply entered his address as the last place we "lived" together.

Thanks for the insight on this Ryan. and the other replies. It's been a big help for me. I added the passport info in the I-130. I decided to leave the 1 month of living in the Philippines since although you have a good point. I never was able to mention that it was part of a transition of me moving to Virginia. It would leave a gap in the address section for last 5 years.

Hi thanks for sharing. You mind stating how that went for you guys? Did you add it in the list of addresses that you have for last 5 years?

That changes things, in this one specific circumstance, it would be entirely appropriate to say you were living there.

I didn't add it to the last 5 addresses since I wasn't technically "residing" or "living" there.  However, we did essentially "live together"  which was the nature of the question.

For the duration, I entered the week that I stayed there during the visit.

 

Our I-130 was approved last month  with no RFEs

Just a note:  From and To Dates should match for the last 5 years of residence.  It doesn't always happen but there is a slight possibility they will notice the gap and issue an RFE or question why the gap exists.  

 

Note that if you are the intending immigrant, the DS 260 will require you to provide all places of residence since the age of 16 - these dates should match whatever you are putting on the I-130.

Nice! Thanks for the heads up with the ds-260. I guess I'll remind her that'll have to be added later. I just sent the I-130 yesterday afternoon. East coast time.
