Hi guys. My fiance was a newly grad last year and got his first job last year month of october. We have his ITR , pay stubs and job contract stating his salary for a year which good enough and above the poverty line. My question is obviously his ITR can't be pass the poverty line cos it's only from oct-dec.. Do you think we will face a problem on US Embassy? cos they say it only based on ITR...Any recommendations?  Thanks you

Yes all those things will be good, being his ITR is low.   I don't see there will be a problem.  I know of a fair number with new employment that did just as you are doing, all got their visas. :thumbs:

 

Do make sure to have copies of all for your interview.

I would highly suggest contacting someone within your Embassy, or USCIS. When we applied for my husbands AOS I had been working my new job for less than a year but was making well above the poverty line. I asked a friend who's an immigration lawyer and she said absolutely get a co-sponsor. So we did. During our AOS interview I was asked if I was making the same income and I said yes, but also took the opportunity to ask if a co-sponsor was even needed since I passed the poverty line. The Immigration Officer said we had a strong enough case for it not to be a red flag but sometimes it's a blurry area and they prefer a cosponsor. So if you can reach out to your embassy, or anyone who has gone through your embassy, it would be a good idea.

I totally agree with SAGOT.     Many have done just as you are talking about at USEM and had zero issues.   Bring copies of as many pay stubs as possible and, of course, a copy of the employment contract.  You will be fine.  :thumbs:

 

There is no need to contact the embassy OR USCIS... btw USCIS has NO connection with the visa applicaiton in the Philippines. two totally different government entities... that don't relate beyond the embassy needing an approved petition.

 

Lawyers have their place, but I have seen more bad advice or practices from lawyers during the visa process.

I agree with both Sagot and Hank on this. Just follow the directions given in you Embassy's letter and all will be fine and you will pass. We saw awhile back where a USC was graduating from medical school and hadn't startedworking and he was approved with no need for a sponsor. Things are different at each embassy so be aware of what is said by others from other country's.  Their heart is in the right place but can't make a men's for bad information.
