I-912 Fee Waiver

My spouse want to apply for N400. However, due to her health condition, she is unemployed. I am the only one working. She is trying to apply for I-912 fee waiver. However, here is the situation, she is not eligible under the means test. She is not receiving any state assistance because she is on health insurance policy. I am the one taking care of her. On household income, she is not eligible because my income is over the median income. However, I believe she will be eligible under special hardship. She is unemployed because she was diagnosed kidney failure few years ago. Currently, she is undergoing dialysis. I don't know if that can qualify her for fee waiver. She has no assets or any investment. If see get a letter from her doctor, will that help. Please I need your opinion. Thanks.

Hi there,

you will find the details about the financial hardship route in part 6 of the form i-912 instructions (on the USCIS website).

In two words, it includes medical expenses and unemployment, which seems to correspond to your wife's situation. Nevertheless, be aware that your request has to be very well documented. A letter from her doctor would not hurt (but on top of all the other documents that you have to provide).

If your request for fee waiver is rejected, your entire application is returned to you. You then have to send it again with the payment for the fee. You'll waste a few weeks in the process.

But saving over $700 is worth trying.

I am confused about part 8 of form i-912. Who should fill this in. Requester is wife, husband perpared the form i-912 but she understands and speaks english well.
