Hello,

 

I am a college student and a US citizen, and I am trying to sponsor my mother, but my income is too low, so my dad is filling out the Form i-864 as a joint sponsor because his income is enough to sponsor my mother. My parents divorced about 10 years ago, and I do not have a stepmom. My father and I did the tax return separately this year, but I am included as a dependent in my father's tax return. I have a brother and sister that were listed as dependents under my father as well.

While filing out the i-864, I have run into a few problems:

In my i-864, under part 6 where it says "Income you are using from any other person who was counted in your household size," do I include my father's information? I am confused by this because I do not include my father in my household size in part 5 (My household size is 2 because of my mother and myself. Is that right?)

In my father's i-864, in the same section in part 6, do I include myself, since I am included in my father's household size? My father's household size ends up being 5 because of my mother, my father, and his 3 dependents (me, my brother, and my sister). Is this correct?

I really hope you are not saying that you are on 2 tax returns, one for yourself and also on your fathers!!

I am only on his as a dependent, but we did not include my income in his tax return. We have separate 1040 tax returns.

That is not legal. You cannot be on 2 returns. Straighten that out fast!

Okay, so what am I supposed to do with the problems I asked about in my original post?

you aren't combining incomes, so 2 in your i864

 

and on his i864 he will list your mom plus all his dependents

 

but as said you have to amend taxes you can't file your own taxes as single and then your dad file his taxes and put you as his dependent
